with all other regulations of this Chapter applicable to the use including but not limited to. <br />setback, lot coverage and site development standards. <br />c. if the structure is located on a lot and encroaches in a required setback area, expansion of <br />the structure may be allowed only to the extent that the expansion does not encroach into <br />required setback or yard areas. <br />d. If the structures height is nonconforming, expansion is allowed if the expansion does not <br />create any other nonconforming condition and if the newly constructed portion does not <br />exceed applicable height limitations. <br />e. If the required number of off-street parking spaces is provided for the proposed expansion in <br />accordance with this Chapter and Section 16-263. <br />Based on this regulation, there is no Indication or expectation that the City should require the building to <br />be removed from the site. There is no existing nonconforming use, the building does not conflict with <br />post -mining land use, and the nonconformity as to setbacks appears to be allowed to remain If the <br />property owner wished to re-establish mill operations on the site, they would be able to pursue that option <br />through rezoning the property to a Planned Unit Development (PUD) QR the Special Review Use Permit <br />(SRU) process as permitted in Sec 16-76(c)(2) which states `Mining and mining related uses, including <br />mining heritage uses, such as a mining museum which preserve the community's mining heritage, may <br />be permitted if they are not a threat to public health and safety and do not adversely impact surrounding <br />land uses.' <br />Maintaining the current vacant use of the building or establishing a new reuse of the building (and <br />stepping through the processes that may be required for a particular use) is a property owner decision <br />and preference.
