Tonya indicated that a bond
release application will be submitted within the next few weeks for these remaining area. SCC has not initiated
repair work approved with TR69, due to ongoing litigation.

The landowner, has created additional non-mining disturbance within the Tract 71 area. Two new trenches have
been dug. One trench runs north-south on the east side of the wood storage area. This starts by the recently buried
waterline that replaced the Martin-Crawford ditch on the South end, and extends northwards to the historic rock
wall. The trench then turns eastward and follows allow the south side of the rock wall to the border of the Carey
property. All of the new disturbance lies within Mr. Fontanari’s property. The trench appears to avoid di sturbing
the historic rock wall, but some of the material dug up from the trench is on the side of the wall on the eastern side
of this new disturbance. The east-west trench was walked and no surface expression of underground holes were
noted in this new trench. The north-south trench was not walked the entire length. No water has been run in this
trench. At this time it is a rough trench and has not been shaped into a ditch or any defined structure.

SUBSIDENCE – Rule 4.20:
TR69 repairs have not been initiated.

The ground surface overlying underground workings in Tract 71 is not flat, the entire area slopes eastward.
Undulations on the surface may be naturally occurring. Without a higher level of detail of the pre-mining
condition, there is little way to visually confirm that the surface condition is due to anything other than the natural
formation.

DOCUMENTS RECEIVED NA
OTHER (SPECIFY) NA

ENFORCEMENT ACTIONS/COMPLIANCE

No enforcement actions were initiated as a result of this inspection, nor are any pending.
