S. Utilities. Kilgore shall obtain all utilities required for its operations and shall pay <br />for all such utilities during the term of this Lease. Kilgore shall be liable for all maintenance and <br />upkeep of all utilities or equipment. Parkerson shall not be liable for the cost, condition, <br />maintenance or performance of any utility infrastructure or any Kilgore equipment. <br />6. Securitv and Safe • Compliance with Law. Kilgore shall be solely responsible <br />for the security of Kilgore's property and equipment. Kilgore shall be responsible for initiating, <br />maintaining and supervising all safety precautions and programs in connection with the occupancy <br />and use of the Properties including any program required by applicable laws and regulations <br />regarding mining. Kilgore shall erect and maintain, as required by existing conditions, reasonable <br />safeguards for safety and protection, including erecting barriers, posting danger signs and other <br />warnings against hazards, and promulgating safety regulations.
