ton for the sold Sand and Gravel. The sold Sand and Gravel shall count as part of the Production <br />Royalty set forth below. <br />3. Included Ri hts. <br />(a) Included in the rights granted to Kilgore hereunder are the rights: <br />(i) to stockpile Sand. and Gravel on the Properties; and <br />(ii) to use the Properties for processing plants, scale houses, sales <br />offices, crushing, screening, and washing plants, and storage of related equipment, as permitted by <br />the respective governmental entities for each individual pit. <br />(b) Parkerson shall not be liable for the cost, condition, maintenance or <br />performance of any facilities or equipment installed or brought upon the Properties by Kilgore. <br />Upon termination ofthis Lease for any reason, Kilgore shall remove all stockpiled Sand and Gravel <br />that has been paid for as part of the Royalty and shall remove all equipment and facilities installed <br />or belonging to Kilgore from the Properties, subject to the Property Reclamation provided for in <br />Paragraph 8 below. <br />4. Rent. Any monetary obligations of Kilgore to Parkerson under the terms of this <br />Lease are deemed to be ("Lease Payments"). In consideration for the Lease, Kilgore agrees to and <br />shall pay to Parkerson: <br />(a) Production Royal . Kilgore shall pay Parkerson a royalty at a rate of Two <br />Dollars ($2.00) per ton (the "Production Royalty") for any Sand and Gravel sold or removed from <br />the Properties. <br />(b) Ro a Ly Minimum.
