To: Jared Ebert <br />Date: February 14, 2018 <br />Page 16 <br />Comment 44a <br />The Division received an objection from the No Laporte Gravel Corp. One of the issues <br />raised in the objection was a concern vegetation grown in the bottom of the pit <br />excavation would have greater exposure to possible toxin such as Selenium (Se)from the <br />Pierre Shale pit bottoms which could provide a risk to both wild and domestic animals. <br />Please provide a response to this concern. <br />Response 44a <br />The pit bottoms will be covered with over three feet of cover material at closure. <br />Because the Pierre Shale has a low hydraulic conductivity and is relatively dry, the only <br />mechanism for moving constituents upward into the cover material will be by molecular <br />diffusion, which is a slow process in and of itself When occurring in relatively dry <br />materials, molecular diffusion is even slower. Regardless, LRM commits to sampling <br />vegetation after closure to evaluate if plant uptake is an issue. <br />Comment 44b <br />The Division is currently consulting with Colorado Parks and Wildlife regarding this <br />response. If any additional adequacy items pertaining to this issue are identified they <br />will be forwarded to LRM as soon as possible. <br />Response 44b <br />LRM welcomes comments from the Colorado Parks and Wildlife. <br />RULE 6.4.12 EXHIBIT L - RECLAMATION COSTS <br />Comment 46a <br />The information necessary to calculate the cost of reclamation was not submitted. In the <br />case of financial warranty forfeiture, the Division would be responsible for structure <br />demolition of office and processing facilities, backfilling and grading, topsoiling and <br />revegetation of the affected land. Upon review of the mining and reclamation plan, the <br />Division believes it would be appropriate to set the bond amount at the cost to complete <br />reclamation assuming mining had occurred and ceased at the end of Phase II Based on <br />this assumption,please supply the following information: <br />a. Please provide an inventory of all mining-related structures to be built or <br />placed on site such as processing facilities, shops, warehouses, mine offices <br />and/or trailers,fuel storage tanks/facilities, etc. <br />Response to DRMS Adequacy Review 3 comments T E L E S T 0
