In the original Plan, the material in the ore pile was to be removed and transported to a mill for <br />refining; current market conditions for UraniumNanadium make that uneconomic given the low <br />quality ore found in the pile. In accordance with the 43 CFR, 3809 regulations, however, <br />disturbance made to the pile and immediate surroundings during the bulk sampling process are <br />required to be reclaimed. This will include reshaping the pile so that it is stable with regard to <br />erosion. In addition, as was discussed, the disturbed portion will require covering with <br />topsoil/growth medium and then seeded, which is consistent with the authorized Plan. The <br />source of this topsoil was originally designated to be various locations within John Brown <br />Canyon, but this plan is deemed to be arduous: the distance is at least 4 miles with a large <br />elevation gain, and the rock type found at the designated location is substantially different from <br />the local geology. A different source is much more appropriate: 3-4 range improvement <br />stockponds within 0.5 miles of the ore pile (see enclosed map.) In addition, this achieves the side <br />benefit of cleaning out affected stock ponds for the immediate future. The use of stock ponds for <br />topsoil sourcing was approved by BLM Range Specialists in the Grand Junction Field Office. <br />These changes are deemed to be a minor modification since they 1) do not increase or change the <br />disturbed surface area, and 2) result in active reclamation toward closing the Plan of Operation. <br />The reclamation cost estimate was included with your Plan of Operation submittal, and set at <br />$13,200.00. The periodic Three -Year Review was made on this reclamation cost estimate, and we <br />have determined it to be adequate based on the current level of activity. <br />If you are adversely affected by this decision, you may request that the BLM Colorado State <br />Director review this decision. This decision will remain in effect while the State Director Review is pending, unless <br />you request and obtain a stay (suspension) from the State Director. If you request a stay, you have <br />the burden of proof to demonstrate that a stay should be granted using the standards and procedures <br />for obtaining a stay (43 CFR 4.21) from the Interior Board of Land Appeals (IBLA). <br />If the State Director does not make a decision on your request for review of this decision within <br />21 days of receipt of the request, you should consider the request declined and you may appeal <br />this decision to the IBLA. You may contact the BLM Colorado State Office to determine when <br />the BLM received the request for State Director Review. You have 30 days from the end of the <br />21 -day period in which to file your Notice of Appeal with this office at 2815 H Road, Grand <br />Junction, CO 81501, which we will forward to IBLA. <br />
