stipulation response file, revisions to the permit, and the findings document for RN3. <br />Stipulations are a binding part of the permit and previously assigned stipulation numbers are not <br />re -used. Any stipulations associated with the Yoast Mine permit and issued over the life of the <br />operation which are not discussed in this Midterm Review document have been complied with or <br />terminated. <br />Stipulation No. 19 was deemed by the Division to be complied with on 10/30/2009. <br />Stipulation No. 19: Documentation of the Office of the State Engineer approval of Ponds 010, <br />013, and 014 as permanent impoundments, along with documentation that any necessary water <br />rights have been obtained for the impoundments, will be provided to the Division prior to final <br />bond release application for the impoundments. <br />Status: Stipulation No. 19 was added to the Yoast Mine permit via Technical Revision No. 37 <br />(TR37, Proposed Decision date of 12/4/2008). Stipulation No. 19 required information specific <br />to Ponds 010, 013, and 014. Minor Revision No. 39 (MR39, Decision date of 10/30/2009) <br />provided this information relating to Ponds 013 and 014, but not Pond 010. Based on a review <br />by the Division of the information submitted with TR37, the information requested for Pond 010 <br />had in fact been submitted with TR37; as such, Pond 010 should not have been included in <br />Stipulation No. 19. The Division therefore finds that Stipulation No. 19 was "Complied With " <br />on 10/30/2009. <br />No new stipulations have been added with the review of Permit Renewal No. 4. <br />SECTION V — PERMIT VARIANCES AND SPECIFIC APPROVALS <br />The Division previously granted variances from contemporaneous reclamation requirements for <br />portions of the Yoast Mine. Changes to the reclamation schedule for various areas at the Yoast <br />Mine were approved with Technical Revision No. 20. Pursuant to Rule 4.14.1(1)(c), the <br />Division approved a variance from the requirements that rough backfilling and grading be <br />conducted within 180 days following coal removal. This variance applied to the North Area pit <br />and to the northern portion of the Yoast South Area pit. Mining has been completed at the Yoast <br />Mine and the variances are no longer necessary. The entire Yoast Mine including the North <br />Area pit and South Area pits have been reclaimed. <br />SECTION VI — BONDING SUMMARY <br />A compiled reclamation cost estimate was developed by the Division as a part of the Permit <br />Renewal No. 4 (RN4) review process in March of 2017. The Division's reclamation costs have <br />not been updated since that date. A summary of those costs in addition to any revision <br />adjustments were completed for the RN4 less than one year ago. The Division currently holds a <br />corporate surety in the amount of $2,221,677.26. This bond remains in force for the 2015-2020 <br />permit term. The above bond calculation is the Division's projection of reclamation costs for <br />maximum reclamation requirements, which would occur during the proposed permit term. The <br />cost estimate for bond liability has been revised as a result of the renewal application with costs <br />updated in 2017.
