Doug Smith of Oxbow Mining accompanied the inspection. The weather was clear and dry, with a <br />little snow on the ground. The status of the Elk Creek Mine, as far as the Division is concerned, is “Active” <br />however no coal is being mined and all activity at the site is focused on the early stages of reclamation. <br /> <br />AVAILABILITY OF RECORDS – Rule 5.02.4(1): <br /> Records were available in the mine office, details are given at the end of this report. <br /> <br />BACKFILL and GRADING – Rule 4.14 <br />Contemporaneous Reclamation 4.14.1; Approximate Original Contour 4.14.2; Highwall Elimination 4.14.1(2)(f); <br />Steep Slopes 4.14.2, 4.27; Handling of Acid and Toxic Materials 4.14.3; Stabilization of Rills and Gullies 4.14.6: <br /> Rundle Construction of Hotchkiss, CO, were continuing to reclaim the section of Elk Creek under the <br />middle pad. At the time of the inspection it was estimated that about 60% of the material had been moved. <br />Sections of the 9’ culvert had been removed and crushed, but the contractors had not successfully recovered any of <br />the culvert. The reclaimed slopes of the stream channel were being covered with topsoil after grading.
