Regulations, and the approved reclamation plan have been completed with respect to any or all <br />of the Affected Lands." <br />We believe the area known as the Little Johnson Amendment is suitable for reclamation liability <br />release for the following reasons: <br />The permitted post mining land use, according to the March 2005 Amendment was to be <br />wildlife habitat. The Security Water District (the primary landowner) has converted the <br />Little Johnson Amendment area into a solar farm. <br />• The area is no longer available for mining. In addition, none of the area was affected by <br />CMC/TMCC mining or reclamation operations. <br />• The pre -mining land use was industrial, which is what the Security Water District is now <br />using the site for. <br />• The Fountain Mutual Irrigation Co. easement has not been affected. <br />• The area we are calling the little "notch" has not been affected by CMC/TMCC. (It may <br />have been disturbed by installation in 2017 of a public potable water line.) <br />• Finally, since the area was not mined or affected by CMC/TMCC, the approved mining <br />and reclamation plans are moot. <br />We also suggest to the Division, a revision to the permit to change the post mining land use from <br />wildlife habitat to commercial or industrial would not serve any practical purpose. The change <br />to industrial (a solar farm) was made by the land owner and has already occurred. There is <br />nothing CMC/TMCC may do to modify what has or will occur on the Security Water District's <br />property or on the other properties as well.
