January 19, 2018 RECEIVED <br />Division of Reclamation, Mining and Safety JAN 2 3 2013 <br />Attention: Mr. Tim Cazier <br />1313 Sherman St. Rm 215 DMSION OF RECLAMAT'O <br />Denver, CO 80203 MINING AND SAFETY <br />RE: Request for Release of the Area Known as the Little Johnson Amendment Area, Daniels <br />Sand Pit #2, Permit No. M1973-007SG, Certified Mail No. 7017 1070 0000 7469 0102 . <br />Dear Mr. Cazier; <br />Enclosed is a release request for the Little Johnson Amendment Area. The release area, <br />according to the El Paso County Assessor's Office records totals 66.18 acres. (Please see the <br />attached El Paso County Accessor maps.) Even though the County Assessor maps are of small <br />scale, they accurately show the release areas, remaining permitted areas, and acres. <br />The March 2005 amendment which incorporated the Little Johnson area into M1973-007SG <br />stated 62.0 acres would be added to the permitted area. <br />• The parcels of land which contain the Little Johnson Amendment (LJA) area consist of <br />60.79 acres (the northern portion) and 3.07 acres (the southern portion) which total 63.86 <br />acres. <br />• In addition, the LJA includes a portion of the Fountain Mutual Irrigation Co. Ditch <br />easement, 2.20 acres. <br />• It also includes a little "notch" like area just to the north of the Ditch easement, . l l acre. <br />It appears the little "notch" is now owned by KDW Trust #1, Block 260 LTD. <br />• We can find nothing in the existing files as to why the amendment documents show 62.0 <br />acres. All the historic maps show the area which was included into the Permit area as <br />66.18 acres. <br />Therefore, we are asking for release of 66.18 acres so the released area will equal the area shown <br />by the El Paso County Assessor's Office. <br />We believe the remaining permitted acres should now be 290.3 acres. (352.3 permitted acres - <br />62.0 acres released = 290.3 acres). We suggest the difference, 4.18 acres (66.18 - 62.0), should <br />not be used in the calculation since they were not included in the original permit amendment. <br />The affected acres should not change since none of the requested release acres were affected. <br />`Rule 4.17 M) Operator Requirements. <br />The Operator of any mining operation possessing a ... 112 Reclamation Permit may file a <br />written notice or completion of reclamation and request for release of reclamation responsibility <br />with the Office whenever an Operator believes any or all requirements of the Act, the Rules and <br />
