2.05.6 Mitigation of the Impacts of Mining Operations <br />(1) Air Pollution Control Plan <br />(1)(a) All permit applications for new operations shall contain a copy of <br />the application for an emission permit and shall be updated <br />accordingly as initial or final decisions are rendered. <br />A copy of the emission permits are presented in Volume II, <br />Appendix E, Air Pollution Emission Permits. The emission permits <br />are actually referred to as construction permits. <br />(1)(b) Other than the above referenced air emission permits, no other <br />permit applications are known to be necessary to comply with other <br />applicable State or Federal air quality laws or regulations. <br />(2) Fish and Wildlife Plan <br />(a) A Baseline Wildlife report is presented and discussed in Section <br />2.04-11. <br />(a)(i) The Division of Wildlife's (DOW)letter dated February 1, <br />2008 located in Volume II, Tab Q, summarizes its concerns <br />about the McClane Canyon Mine's proposed coal mine <br />waste disposal area. Their concerns are related to the small <br />TR -16 coal mine waste pile and projected water impacts. <br />Water depletions in the Upper Colorado River Basin have <br />been recognized as a major source of impact to endangered <br />fish species (USFWS 2/93). The Applicant agrees to <br />implement the conservation measures that the USFWS <br />believes are necessary to offset the water depletion impact. <br />See Appendix P for the estimated water consumption <br />(depletion) by the mining. See Section 2.04-11 for a full <br />discussion of the potential for impacts to rare and <br />endangered species, and USFWS required conservation <br />measures. <br />PR -02 2.05-53 10/12 <br />
