Due to the unauthorized access, the operator
has placed impediments in the roadway. Under the circumstances, the Division finds this action acceptable.

Unauthorized access appears to be coming in Light Use Road #2. The operator has re-established the gate and
place other restrictions on this roadway. The Division finds this action acceptable. Should the operator or
landowner require use of the road, the operator will take necessary action.

SLIDES and DAMAGE - Rule 4.12:
No new rock fall was observed at the portal area. Rock fall protection fencing remains in place at the
portal.

SUPPORT FACILITIES - Rule 4.04:
The inspector met up with Chuck Silengo, representing McClane Canyon Mining. The mine has been
broken into again. MCC has taken precautions to attempt to impede future break-ins. The unauthorized access
has not damaged hydrologic controls, materials storage areas, sumps or culverts. It does not appear that the mine
seals have been damaged. As a result of this second brake-in, the operator is taking additional precautions to
impede further unauthorized access. These efforts are acceptable to the Division, and do not reduce the function
of the hydrologic controls, or function of the facilities.

OFFSITE SUPPORT FACILIITES - Rule 4.04, 4.28:
Mine records are stored off-site at the offices of J.E.
