XII. Post -mining Land Use <br />No specific approvals are granted under this section. <br />XIII. Protection of Fish, Wildlife and Related Environmental Values <br />A. Fish and wildlife habitat is secondary use of the reclaimed area. The applicant <br />has a plan for the re-establishment of shrubs on portions of the reclaimed areas <br />of the surface mine. (4.18(5)(I)) <br />XIV. Protection of Underground Mining <br />A. The Division does not approve surface coal mining activities being conducted <br />within 500 feet of an active or abandoned underground mine. (4.19(1) and <br />4.22.4(1)) <br />XV. Subsidence Control <br />No specific approvals are granted under this section. <br />XVI. Concurrent Surface and Underground Mining <br />No specific approvals have been granted under this section (4.22.2). <br />XVII. Operations on Alluvial Valley Floors <br />A. The Division has determined that an alluvial valley floor exists within the <br />adjacent area of the Lorencito Canyon Mine. The Purgatoire River AVF is <br />located at the mouth of Lorencito Canyon and flood irrigated by the Chacon <br />ditch. <br />The Division finds that activities proposed by the applicant will not interrupt, <br />discontinue, or preclude farming on the alluvial valley floors that are irrigated or <br />naturally sub -irrigated. (4.24.3(l)). <br />The proposed activities will not materially damage the quantity or quality of <br />water in the surface or ground water systems of the Purgatoire River AVF. The <br />Division has determined that possible changes in water quality would be small <br />and would not affect the usability of this water for irrigation. (4.24.3(3) and <br />2.06.8(5)(a)(ii)) <br />B. Alluvial wells hydrologically above and below the coal loadout where installed <br />as a result of Permit Revision No.1 (PR -01), however the requirement to monitor <br />surface water and alluvial water quantity and quality has been terminated by <br />Technical Revision No. 16 (TR -16).
