Compliance with this Stipulation was partially met with two technical revision (TR's), TRI 15, <br />TRI 17 and through the midterm review process (MT6). The documentation on compliance with the <br />Stipulation follows: <br />TR 115 updated post mining topography, mine plan updates and selected 2015 Midterm Review <br />(MT6) Responses. Three new monitoring wells were drilled on the eastern edge of the mine site in <br />the PR7 expansion area. The Annual Hydrology report compiles the monitoring data for these wells. <br />Topsoil stripping limits were revised on Map 10a to reflect the proposed additional 41.1 acres of <br />disturbance related to stripping beyond the approved PR7 disturbance. <br />TRI 17, provided as built designs for the Deacon/Jeffway and Deal Diversion ditches located on the <br />eastern edge of the site. The TR was approved in January 2015. Modeling and sediment pond <br />designs submitted for this area are currently under DRMS review through Permit Revision 8 (PR8). <br />The submittal, documentation and current DRMS review of the new pond designs (PR8) constitute <br />the one remaining item in addressing Stipulation 21. <br />Selected Midterm responses addressed relate to Rule 2.05.3(4). As built drawings for East Pyeatt, <br />Middle Pyeatt, Johnson, No Name, and Ute Pond systems will be submitted in a forthcoming <br />Technical Revision. The need for these pond designs is not related to Stipulation 21, but to the 2015 <br />Mid Term Review. <br />Stipulation No. 22 was attached to the permit in conjunction with Permit Revision No. 7 (approved in <br />August 2015). Compliance for this Stipulation was reviewed by DRMS as part of this renewal <br />process. Stipulation No. 22 states: <br />Prior to disturbance within the 795.72 -acre PR7 permit expansion area, the permittee must submit <br />and receive approval of an application for a permit revision that contains the following required <br />information for this area: <br />a. A narrative of the land capability and productivity before any mining in <br />accordance with Rule 2.04.3(2)(b). <br />b. Cultural and historic resource information for areas proposed or likely to be <br />affected by surface mining activities in accordance with Rule 2.04.4. <br />C. A geology description that updates Sections 2.7.2 and 2.7.3 of the Trapper <br />Mine permit application package with the information required by Rule <br />2.04.6(2) (a) and (b). <br />d. Surface water information in the hydrology description with water quality <br />data from surface waters in, discharging into, or which will receive flows from <br />surface or ground water from affected areas within the proposed permit area in <br />accordance with Rule 2.04.7(2)(b)(ii). <br />e. Soil resource information required by Rule 2.04.9 for those portions of the <br />permit area to be disturbed by surface operations and facilities. <br />f.
