The stipulation was complied with when MR -146 was approved. <br />Stipulation No. 34 required within 45 days off issuance of TR -77, BRL must submit a technical revision <br />to address the following for proposed Borrow Areas #1, #2 and #3 at Gob Pile #2: <br />a. A topsoil salvage, storage and redistribution plan in accordance with Rules 2.05.3(5), 2.05.4(2)(d) <br />and 4.06.4(2); <br />b. A regrading plan in accordance with Rules 4.14.1 and 4.14.2; <br />c. A revegetation plan in accordance with Rule 4.15; <br />d. A sediment controlplan in accordance with Rules 2.05.3(4), 2.05.6(3), 4.05.1 and 4.05.2; <br />e. Revised map(s) in accordance with Rule 2.10.3, clearly indicating the areas proposed for <br />disturbance; <br />f. A reclamation plan and cost estimate in accordance with Rule 2.05.4; and <br />g. A commitment from BRL that materials excavated from any borrow area will be direct hauled for <br />the purpose of covering refuse material, and will not be incorporated into the refuse material, <br />such as for drying purposes. <br />The revision submittal due date was subsequently extended until October 15, 2014. The stipulation was <br />complied with when TR -98 was approved on June 9, 2015. <br />Stipulation No. 35 required when commencing with the issuance with TR -77, BRL must conduct a survey <br />to determine the volume of coverfill material in the stockpiles associated with Gob Piles #1, #2, #3, and <br />#4 on at least a quarterly basis. A report summarizing the survey shall be submitted within 30 days of the <br />survey, and must include a statement of whether the volume of available material is sufficient to meet the <br />requirements of Rule 4.10.4(5) and the material balance in the currently approved PAP. The stipulation is <br />active and is complied with in a section of the waste bank reports submitted to the Division quarterly. <br />Stipulation No. 36 required that BRL must submit a plan for vibrating wire piezometer (VWP) <br />installations on Gob Pile #3 to be approved and implemented during the Calendar Year 2014. The <br />stipulation was complied with when TR -84 was issued. <br />Stipulation No. 37 required within two weeks of the proposed decision to approve, with conditions, <br />Technical Revision No. 87, BRL must submit a revised Form 1403 to clarify that the Coal Sales House is <br />a contributing feature of the King Mine. The Coal Sales House may not be demolished until the form has <br />been approved by History Colorado and the Division. The stipulation was complied with when TR -87 <br />was issued. <br />Stipulation No. 38 was apart of the conditions to approve Permit Revision No. 14. The stipulation <br />required that prior to any surface disturbance of lands within the Spruce Stomp Lease Area (COC -75916), <br />the baseline Vegetation Information required under Rule 2.04. 10 must be submitted to and approved by <br />the Division. This Stipulation is categorized as Future/Ongoing, The Spruce Stomp Lease Area has not <br />been affected by mining activities due to BRL not obtaining the right of entry for the area. <br />Stipulation No. 39 was a part of the conditions to approve Permit Revision No. 14. The stipulation <br />required that prior to any surface disturbance of lands within the Spruce Stomp Lease Area (COC -75916), <br />the baseline Soils Resource Information required under Rule 2.04.9 must be submitted to and approved by <br />the Division. This Stipulation is categorized as Future/Ongoing, The Spruce Stomp Lease Area has not <br />been affected by mining activities due to BRL not obtaining the right of entry for the area. <br />Stipulation No. 40 was a part of the conditions to approve Permit Revision No. 14. The stipulation <br />required that prior to any surface disturbance of lands within the Spruce Stomp Lease Area (COC -75916), <br />BRL will need to evaluate the effects of that disturbance on any of the sites listed as eligible for listing on <br />
