The approval of the relocation of one gob vent borehole through Field Minor Revision No. 61 was <br />contingent on the resolution of Stipulation No. 23. This stipulation was complied with when the permit <br />text, map and reclamation cost estimate were submitted. <br />Stipulation No. 24 required the submittal of permits from the Colorado Department of Transportation and <br />the US Bureau of Reclamation before the elevated conveyor could be constructed to gob pile 3. With the <br />approval of the haul road in TR -49, the elevated conveyor was not needed and the stipulation was <br />terminated. <br />Stipulation No. 25 required the submittal of maps and revised pages addressing the temporary storage of <br />topsoil from the Hubbard Creek Vent Shaft. Stipulation 25 was complied with MR -84. <br />Stipulation No. 26 requires that an air quality/construction permits from Air Pollution Control Division <br />(CDPHE) be submitted before coal waste can be transported across the Bowie Road (Old Highway 133) <br />to Coal Waste Pile #3. The stipulation was complied with when MR -142 was approved. <br />Stipulation No. 27 required the modification of construction permit 03DL0923F by the Air Pollution <br />Control Division to allow for a greater amount of stockpile material. The construction permit was <br />approved and the stipulation was complied with. <br />Stipulation No. 28 required approval of a lease modification fcl-d-036955 and associated mine plan with a <br />technical revision into the Bowie No. 2 mine permit application. The stipulation was complied with when <br />TR -70 was approved. <br />Stipulation No. 29 required prior to the placement of cover on the eastern portion of Gob Pile #4, BRL <br />needed to survey the eastern portion of the pile to verify that slopes were not steeper than 2:1 and regrade <br />any slopes as necessary to ensure conformity with the approved slope design. Documentation of the <br />corrected slopes needed to be submitted to and approved by the Division before cover could be placed on <br />the eastern portion of the disposal area. The area to be surveyed and regraded is depicted on the February <br />20, 2013 review drawing submitted with the Technical Revision No. 75 application. The stipulation was <br />complied with when TR -75 was approved. <br />Stipulation No. 30 required the 14,000 cy of cover fillmaterial approved to be moved from the B Portal <br />storage area must be directly hauled to, and used as permanent cover material for, regraded portions of <br />Gob Pile #4. Material moved from the B Portal storage area may not be mixed with or incorporated into <br />the waste material. The stipulation was complied with when TR -83 was approved <br />Stipulation No. 31 required prior to removal of topsoil along the Pitkin Mesa pipeline, all snow in the <br />topsoil removal area shall be removed. Topsoil may not be removed if ground conditions are wet or <br />snowy. Photographic documentation of conditions at topsoil removal shall be recorded and submitted to <br />the Division. The stipulation was complied with when MR -146 was approved. <br />Stipulation No. 32 required prior to the excavation through Stevens Gulch Road, Bowie Resources, LLC <br />must submit, to the Division, documentation of Delta County's acknowledgment of the excavation <br />activities within the roadway. The stipulation was complied with when MR -146 was approved. <br />Stipulation No. 33 required prior to any Pitkin Mesa Pipeline replacement disturbance, Bowie Resources, <br />LLC, must determine which subsidence monuments located over the replaced pipeline segment will be <br />disturbed. Any monuments that will be disturbed by the pipeline replacement must be surveyed prior to <br />removal, reset, and surveyed again, with the reset positions calibrated relative to the original locations. <br />No undermining of the pipeline may occur until the monuments are in place and surveyed.
