6. On September 1, 2o17, the Divisi n received a request for a second period <br />of Temporary Cessation ("TC -2") for the site. . <br />7- The Division conducted a normal monitoring inspection of the site on <br />September 27, 2017. A representative of the 61S. Bureau of Land Management ("BLM") <br />attended the inspection. Race Fisher and Todd Eldridge attended the inspection on <br />behalf of Operator. During the inspection, the Division observed, among other things, <br />adequate mine signage and boundary delineate n; two empty propane tanks; and that <br />all buildings and the portal are secured. The D vision found no problems or violations <br />at the site during the inspection. <br />8. The Division received a comment) letter regarding TC -2 from information <br />Network for Responsible Mining (INFORM) on October 20, 2017. INFORM did not <br />wish to be a party to the matter. <br />g. The Division holds a financial warranty for the site in the amount of <br />$375,078. The financial warranty is adequate t.6 reclaim the site. <br />10. Operator has submitted all <br />hydrologic reports. <br />11. Operator has renewed its Water <br />Department of Public Health & Environment. <br />12. Operator is spraying and <br />reports and fees, and quarterly <br />Permit with the Colorado <br />noxious weeds on-site. <br />13. At the hearing, Mr. Bakken and M . Hegarty testified on behalf of <br />Operator that the purpose of TC -2 is not to avoid or delay reclamation, but rather to <br />allow the price of uranium to increase before re I <br />tarting mining. <br />14. The Division supports _ <br />pp rts Operators request for TC 2. <br />CONCLUSIONS OF LAW <br />15. The Board has jurisdiction over th s matter pursuant to the Mined Land <br />Reclamation Act, Article 32 of Title 34, C.R.S. (" ct"). <br />16. Under section 34-32-103(6)(a)(II)� C.R.S., an operator may temporarily <br />cease production upon compliance with the notice requirements therein. Pursuant to <br />section 34-32-103(6)(a)(III), C.R.S., an operatoi may be in temporary cessation of <br />production of up to ten years. <br />17. Under Rule 1.13.8(1)(a) and (b) of the Mineral Rules and Regulation of the <br />Colorado Mined Land Reclamation Board for HArd Rock, Metal, and Designated Mining <br />Operations ("Rules"), a permit shall continue in effect as long as the mining operation is <br />resumed within five years of the beginning of Temporary Cessation or the operator files <br />Energy Fuels Resources (USA), Inc. <br />M-2007-044 <br />2 <br />
