Summit Brick and Tile Company Fox No 1 Clay Pit
M-1977-219 -Adequacy Response#1 November 13, 2017
and identify the location of all permanent man-made structures contained on the area of
affected lands and within 200 feet.
All structures listed are shown on the maps . Careful review will
show this and the legend shows the symbol for each structure . I
added Exhibit C-3-Structures that shows the structures, the
ownership lots and the structures associated with each owners
property within 200 feet of the affected lands .
12. The Exhibit C-1 - Mining Plan Map depicts a proposed access road in the northwest
corner of the site. Based on a Google Earth aerial image, it appears the county road is
approximately 60 feet northwest of what appears to be the approximate northwest permit
boundary corner. Please demonstrate the permit boundary abuts the county road right of
way and there is not land owned by Theresa& Thomas Goodrich between the permit
boundary and the county road.
This road is called Even Road and actually runs thru the
northwest corner of the Donald Hanratty parcel . It is part of
the permit area so the proposed access road will connect directly
to Even Road. I obtained this information from the Pueblo County
Assessors Ownership map portal (http: //maps .pueblo.org/) I then
corrected all of the maps (C thru J) showing the correct
location. I also included a copy of the photo map from that site
in the upper right hand corner of Map Exhibit C-3 for your
reference .
EXHIBIT D - Mining Plan (Rule 6.4.4):
13. Within Exhibit D, the Applicant states the applicable portions of the exhibits described
and approved in the existing permit application and amendments to the mining plan will
remain unchanged. However, due to the scope of AM-03, previous applications are
potentially obsolete. The Division cannot recommend an approval of AM-03 without
being provided all necessary information. The Applicant shall provide all requirements of
Rule 6.4.4 in the form of a new and complete Exhibit D submittal. Although the Division
will review the new submittal for adequacy, the Division still reviewed the AM-03
Exhibit D narrative and provides the following inadequacies.
6
