Please provide the <br /> guidelines and buffer zones details, and clarify how these have been incorporated into the <br /> Mine and Reclamation Plans. <br /> As you say, the CPW recommends complying, but does not require <br /> it . A copy of those guidelines was not included with the letter <br /> we received. After doing some research and reviewing the setback <br /> requirements in them, it is not economically feasible to do what <br /> is suggested or necessary. In most cases the non-disturbance <br /> area for the various listed species varies for one-third to one- <br /> half mile around nesting, resting or hunting sites for much of <br /> the year. This means the diameter of each site could be 1 mile <br /> and with nests tragically placed on the mine virtually no mining <br /> could take place on the site during the year. We believe that <br /> any raptors using the area have been conditioned to the mining <br /> operations and that combined with the very limited amount of <br /> disturbance on the permit area, summit will not, unduly stress <br /> any raptors using the permit area. <br /> 32. Please discuss if the Applicant intends to conduct a raptor survey on the affected lands <br /> during the permitting process of AM-03 and if the Applicant intends to conduct <br /> additional raptor surveys prior to expanding the mining operation into future stages. <br /> No, Summit Brick and Tile Company is not planning to do a raptor <br /> survey for the affected lands or the expansion area. <br /> 33. Please discuss how the Applicant has incorporated the requirements of Rule 3.1.8(1), <br /> which states all aspects of the mining and reclamation plan shall take into account the <br /> safety and protection of wildlife on the mine site, at processing sites, and along all access <br /> roads of the mine. <br /> 15 <br />
