The Operator did not include any costs associated <br />with the access road in its Exhibit L bond estimate, as this area is suitable for the intended post - <br />mining use in its present graded and paved condition. <br />• The subject area for release is distinct from other permitted acreage. This area is a stand-alone lot, <br />already annexed within the jurisdictional limits of the City of Fort Lupton. This area is not part of the <br />Weld County Use by Special Use approval (USR2016-0034) for the permitted sand and gravel <br />operation. <br />• Beneficial use of the subject area is a feature of all future plans. A shared driveway, serving an <br />access easement across Lot 4 to benefit Lots 2 and 3 of the Thomas Minor Subdivision, will include <br />road improvements and common access. The subject land is in planned transition to public <br />ownership. The Valley's Edge Resource will be served by a new front gate at the northern boundary <br />of the constituent mining parcels. <br />The Operator believes that the 0.600 acres requested for release meets all applicable standards under <br />reclamation statutes and Construction Materials Rules.
