Request for Acreage Release, M-2016-030
9 November 2017
Page 2
time, based on state and local legal requirements, the Operator will no longer be able to use its access
road exclusively.
• No release of financial warranties is required. The Operator did not include any costs associated
with the access road in its Exhibit L bond estimate, as this area is suitable for the intended post -
mining use in its present graded and paved condition.
• The subject area for release is distinct from other permitted acreage. This area is a stand-alone lot,
already annexed within the jurisdictional limits of the City of Fort Lupton. This area is not part of the
Weld County Use by Special Use approval (USR2016-0034) for the permitted sand and gravel
operation.
• Beneficial use of the subject area is a feature of all future plans. A shared driveway, serving an
access easement across Lot 4 to benefit Lots 2 and 3 of the Thomas Minor Subdivision, will include
road improvements and common access. The subject land is in planned transition to public
ownership. The Valley's Edge Resource will be served by a new front gate at the northern boundary
of the constituent mining parcels.
The Operator believes that the 0.600 acres requested for release meets all applicable standards under
reclamation statutes and Construction Materials Rules. Brannan understands that the Division will schedule
an inspection of the affected land and welcomes this inspection and any other questions in regard to this
request.
At your convenience, please feel free to contact me at aschatz brannanl.com or by phone at 303-853-5161.
Sincerely,
BRAN NAN SAND AND GRAVEL COMPANY, L.L.C.
encl: Map of area subject to release request
Pre -Annexation Agreement, dated 6 February 2017
