WHE <br />Denver, CO 80203 <br />by Certified Mail <br />Re: Request for Acreage Release, Valley's Edge Resource, M-2016-030 <br />Mr. Hays: <br />REeewa <br />NOV 13 2017 <br />DMWN OF RECLUATlop <br />Wft AND SAFETY <br />This letter concerns the requested release of certain acreage from the Valley's Edge Resource, M-2016-030, a <br />sand and gravel operation owned by Brannan Sand and Gravel Company. In accordance with Rule 4.17.1, the <br />Operator is sending by certified mail this written notice to the Division of Reclamation, Mining and Safety. <br />Brannan requests the release of 0.600 acres (26,120 square feet), a small portion of the permitted site <br />encompassing an access road, from the overall 189.66 acres currently included'within the permit area. Please'`'"') - <br />find the accompanying map exhibit for a graphic depiction of the acreage to be released. <br />The following points are offered for the Division's consideration: <br />• Release of the requested acreage is appropriate in advance of potential dedication of the subject <br />area to the City of Fort Lupton. The current private driveway was intentionally located in the future <br />alignment of a planned roadway to serve lands south of Weld County Road 8, including the 188 acres <br />owned by the Operator (see attached Pre -Annexation Agreement between the Operator and the City <br />of Fort Lupton). The Operator is currently preparing annexation and site plan applications for a <br />portion of this acreage (see separate, concurrent Technical Revision letter to the Division for <br />additional information on these plans). If and when dedication is required, or the access road is used <br />for private easements to serve adjacent land (an alternative scenario in current plans), it is not <br />necessary or appropriate for this land to be encumbered as a mining area. <br />• Release of the area subject to this request is contemplated in current Reclamation Permit <br />documents. Specifically, Nate 10 on Exhibit C-2, as approved, states that, "this access may be <br />dedicated to the City of Fort Lupton as public right-of-way, at the operator's discretion; in this event, <br />the access or other such affected area will be subject to partial release from the reclamation permit." <br />(This Note is also discussed in the concurrent Technical Revision letter to the Division.) <br />• The area subject to this request is necessary to implement plans for use of adjacent parcels. As <br />discussed in Exhibit E of the approved M-2016-030 permit, access roads are integral to the planned <br />use of industrial development. Exhibit F also notes that the access drive will eventually convert to use <br />as public right-of-way. The Operator is required in early 2018 to acquire additional width (to obtain <br />the full cross-section standard for planned future public right-of-way) along the access road, at which <br />2500 East Brannan Way .
