Liberty Mine. Based upon the Southfield PAP, Section 2.04.4 - Cultural and Historic Resources Information, that <br />"[b]y 1940, the area had 55 coal mines, 12 of which had `Canon' as the first word of their name. The mines were <br />similarly undistinguished." The Canon Liberty Mine operations began pre-SMCRA and the Division has no <br />information in regards to how the adit was sealed. <br />3) An area of the north bank of the Magpie Diversion is bare of rip -rap. <br />This area bare of rip -rap along the Magpie Diversion embankment was inspected. During the removal of a pipe <br />that was located along the diversion by Energy Fuels, rip -rap was displaced from the area and was never placed <br />back to the embankment. The area devoid of rip -rap was measured in the Division's inspection report dated <br />February 24, 2017. This area has been documented in previous inspection reports as a maintenance item. At the <br />time of this inspection, maintenance has still not been conducted on the area and is still warranted. <br />4) Freeboard is inadequate along the north bank of the Magepie Diversion at 20+52.6'. <br />As per Rule 4.05.3(7)(b), freeboard shall be no less than 0.3 feet. Protection shall be provided for transition of <br />flows and for critical areas such as swales and curves. Where the area protected is critical area as determined by <br />the Division, the design freeboard may be increased. <br />The Division inspected the north embankment where TCC suggests there is inadequate freeboard along the <br />Magpie Diversion. A GPS point of the area was taken and was inspected visually. It was observed that a low spot <br />along the embankment exists. After discussing the area, it is thought that during the pipe removal along the <br />Magpie Diversion, equipment compressed the top of the embankment down. A survey of the Magpie Diversion <br />done on the behalf of TCC was provided to the Division. According the survey done by John Keilers, CO P. L.S. <br />23890, that 0.6' of freeboard exists along this section of embankment. According the as -built design of the <br />channel, free -board should be 1' for channel sections R -W. <br />5) Inlet of the culvert under the Monarch Fan Road is bent at the inlet resulting in less cross sectional area. <br />Based upon the design found on Map 25 in the Southfield Mine PAP, the diameter of the culvert under the <br />Monarch Fan Road is 8.8'. After a visual inspection, the culvert under the Monarch Fan Road is indeed bent along <br />the left inlet side. Measurements were taken on the cross sectional width and height of the culvert. The width of <br />the culvert from the bent section to the right side was approximate 8' 2". The height of the culvert was measured <br />from the top of the culvert to the base of the rip -rap and sediment that had been deposited inside the inlet. The <br />height measured was approximately 8'. Due to the deformation in the culvert, TCC is correct that the culvert has <br />lower cross sectional area. <br />Currently, the Division is looking into potentially having the Magpie Diversion surveyed pending availability. <br />
