No operator was present during the inspection. <br />The weather was clear and ground conditions were dry. Temperatures during the inspection were around fifty five <br />degrees fahrenheit. On October 17, 2017, the Division recieved a request for inspection by The Corley Company <br />(TCC) as per Rule 5.02.5. The primary focus of this inspection was to examine areas of concern along the <br />Magepie Diversion as listed in the letter recieved from The Corely Company. Dr. Corley, president of the The <br />Corely Company, attended the inspection. In the request for inspection, TCC listed five items in which they have <br />concerns and are the following: 1) The width and depth of the Diversion have never been reported or certified as <br />required. 2) The Magpie Diversion intersects an adit of an underground coal mine according to Southfied Map 25; <br />any resealing is unknown. 3) An area of the north bank of the Magepie Diversion is bare of rip -rap. 4) Freeboard is <br />inadequet along the north bank of the Magepie Diversion at 20+52.6'. 5) Inlet of the culver under the Monarck <br />Fan Road is bent at the inlet resulting in less cross sectional area. <br />HYDROLOGIC BALANCE - Rule 4.05 <br />Drainage Control 4.05.1, 4.05.2, 4.05.3; Siltation Structures 4.05.5, 4.05.6; Discharge Structures 4.05.7, 4.05.10; <br />Diversions 4.05.4; Effluent Limits 4.05.2; Ground Water Monitoring 4.05.13; Surface Water Monitoring 4.05.13; <br />Drainage — Acid and Toxic Materials 4.05.8; Impoundments 4.05.6, 4.05.9; Stream Buffer Zones 4.05.18: <br />1) The width and depth of the Diversion have never been reported or certified as required. <br />As per Rule 4.05.4(2), when streamflow is allowed to be diverted, the design and construction shall be certified by <br />a qualified registered professional engineer as meeting all applicable performance standards and design criteria. <br />On April 15, 1993, Patrick Corser, CO P.E. 28431, signed, stamped and certified that the Magpie Diversion was <br />prepared under his supervision and information regarding the as -built design of the diversion is true and correct to <br />his knowledge. Design and certification of the Magpie Diversion can be found on Map 25 - Magpie Creek <br />Diversion As -Built Drawing. <br />2) The Magpie Diversion intersects an adit of an underground coal mine according to Southfied Map 25; any <br />resealing is unknown. <br />During the inspection, the Division took a GPS point at the approximate location of where the adit is located along <br />the Magpie Diversion. Based upon the GPS point and historical mapping of the area, it appears to be located over <br />the workings of the Canon Liberty Mine. However, due to the number of historical coal mines in the area and lack <br />of details in historical maps, the Division cannot say with certainty if this adit was associated with the Canon <br />
