BEFORE THE MINED LAND RECLAMATION BOARD <br />STATE OF COLORADO <br />Notice of Violation No. AIV -2017-026 <br />FINDINGS OF FACT, CONCLUSIONS OF LAW, AND ORDER <br />IN THE MATTER OF THE REQUEST TO REINSTATE PERMIT NUMBER <br />M-1989-024 <br />THIS MATTER came before the Mined Land Reclamation Board ("Board") on <br />September 27, 2017 in Denver, Colorado as a consent agenda matter consider a <br />request for permit reinstatement by Jeannette J. Yaklich-Houston and Edward M. <br />Yaklich ("Operator"), permit number M-1989-024. <br />The Board, being fully informed of the facts in the matter, hereby enters the <br />following findings of fact, conclusions of law, and order. <br />FINDINGS OF FACT <br />1. Operator holds a 110c reclamation permit for a gravel operation <br />located in Section 30, Township 22 South, Range 72 West, 6th P.M. in Custer <br />County, known as the Shangri La Pit. <br />2. At its meeting on July 26, 2017, the Board found Operator in violation of <br />section 34-32.5-116(3)(a), (b), C.R.S. for failure to submit required annual fees and <br />annual reports. The Board ordered permit number M-1989-024 revoked and the <br />financial warranty for such permit forfeited. The Board issued an order with such <br />terms, effective August 29, 2017. <br />3. On September 5, 2017, the Division of Reclamation, Mining and Safety <br />("Division") received the past du annual reports, maps, and fees from Operator. <br />4. On September 5, 2017, the Division received a written request from <br />Operator to reinstate permit number M-1989-024. <br />5. The Division recommends reinstating permit number M-1989-024. <br />CONCLUSIONS OF LAW <br />6. The Board has jurisdiction over this matter pursuant to the Colorado <br />Land Reclamation Act for the Extraction of Construction Materials, Article 32.5 of <br />Title 34, C.R.S. <br />
