PERMIT#:M-2000-028 <br /> INSPECTOR'S INITIALS:ECS <br /> INSPECTION DATE: October 31,2017 <br /> OBSERVATIONS <br /> This was a DRMS monitoring inspection conducted in response to a citizen complaint. On October 6, 2017, <br /> DRMS received a complaint against the permittee alleging that the site has not been reclaimed within the <br /> mandated five years from the end of mining, and that refuse and vehicles have been left on site for an <br /> extended period of time. DRMS reviewed the available records and confirmed that the last mining activity, as <br /> reported on the most recent annual reports for the site, was conducted in 2011. <br /> DRMS scheduled an inspection of the site with the landowner, Mr. Larry Menegatti, and the permittee, Mike <br /> Ferrero. DRMS met Mr. Menegatti at exit 42 off 1-25 at approximately 9:30 and followed him to the permit <br /> area. Mr. Ferrero arrived shortly thereafter. The required site identification sign and permit boundary <br /> markers were present (photo 1). DRMS observed a dozer, grader and a heavy truck on-site (photos 2-3). Mr. <br /> Ferrero stated that the dozer and grader would be used in reclamation or removed. The truck should also be <br /> removed from the site if it will not be utilized in reclamation activities. DRMS observed refuse of various types <br /> (scrap metal, old tires, misc.junk) on site in several areas. This trash will need to be removed from the site <br /> within 30 days as stated on the first page of this report, and proof provided to DRMS that this has been done. <br /> Although only about 2 acres of the permit area have been disturbed by mining activity (photos 5-6), the <br /> general appearance of the site correlated with the report that the site had not been utilized since 2011. Mr. <br /> Ferraro stated that there would be several days to one week of earthmoving required to re-contour the site as <br /> appropriate and replace the topsoil. Several topsoil stockpiles are present to be utilized in reclamation, and <br /> should provide good growth media. When the site has been re-contoured and topsoil replaced, the <br /> reclamation seed mix should be planted sometime either late this season if weather permits, or early next <br /> spring. Fencing may be required around reclaimed areas to keep livestock from damaging the reclamation <br /> vegetation while it establishes. <br /> As stated on the first page of this report, the permittee is now required to provide for DRMS approval, by the <br /> corrective action due date of December 4, 2017, a schedule to complete required reclamation for all affected <br /> areas. Final reclamation should be completed no later than spring 2018. Timetables for earthwork, topsoil <br /> replacement, and seeding should be included.
