Ben Langenfeld <br /> From: Brown - DNR,Garver <garver.brown@state.co.us> <br /> Sent: Monday, October 23, 2017 11:55 AM <br /> To: Ben Langenfeld <br /> Cc: Jara Johnson - DNR <br /> Subject: Platte City Placer Ditch <br /> Dear Mr. Langenfeld, <br /> It has come to my attention that certain regulatory agencies have expressed concern about the relocation of the Platte <br /> City Placer Ditch at the location of the Fairplay AU Pit.As the District 23 Water Commissioner, I do not object to this <br /> relocation,or to any future relocation of the ditch or any associated laterals of the ditch,so long as the terms and <br /> conditions of the decree, CA1636,are complied with. <br /> Additionally, it is my understanding that the owners of theFairplay AU Pit represent one of several shareholders in the <br /> ownership of the water right, and that no other owners of the water right will be affected by relocating the present <br /> location of the ditch and associated laterals, including the tail water ditch where water returns to the South Platte River <br /> after passing through the numerous mining properties which are served by the ditch. <br /> In Colorado,decreed water rights typically contain the following information:date of priority, amount of water to be <br /> diverted,type of use,and place of use.As long as the diversions of water under the Platte City Placer Ditch water right <br /> confirm to these conditions, and that water diverted is being applied to it's intended beneficial use, and not being <br /> wasted,then any future relocation of the ditch or associated laterals can be effectuated under the present decree. <br /> Thanks for contacting this office for clarification of this issue.
