In addition, update the Mining <br /> and Reclamation Plans to address the removal of the ponds. <br /> These ponds are being removed to facilitate the movement of the Platte City Ditch. The water <br /> commissioner for the district, Garver Brown, has confirmed that the operator may move the ditch <br /> as they see fit. An email from the commissioner's office confirms this, and is attached to this <br /> response. <br /> The removal of the ponds negates any specific mining or reclamation plans for them, as the area <br /> the currently occupy will be mined out and reclaimed as shown on Map C-2. <br /> 3. Please sped,if the Operator has consulted with the District 23 TE titer <br /> Commissioner regarding the relocation of the Platte City Ditch. If so, spec fi•any <br /> additional requirements which must be met. <br /> The operator has consulted with the District 23 Water Commissioner(the above-mentioned Mr. <br /> Brown) and received concurrence that the ditch may be moved by High Speed Mining as they <br /> see fit. This is due to High Speed Mining being the owner of all remaining downstream water <br /> rights on the Platte City Ditch. <br /> Upon reclamation,High Speed Mining will provide the Division with a revised Map F-1 <br /> showing the final ditch location. <br /> 6. Pursuant to Rule 3.1.6, disturbances to the prevailing hvdrologic balance of the <br /> affected land and of the surrounding area and to the quantity or quality of'water in <br /> .surface and groundwater systems both during and after the mining operation and <br /> during reclamation shall be minimized. According to the permit file, High.Speed <br /> Mining. LLC is not the end user of the Platte City Ditch. Please specify how the <br /> Applicant will ensure the water rights of the downstream users of the Platte City <br /> Ditch will not be impacted by relocating the ditch. <br /> Since the operator owns all water rights on the Platte City Ditch downstream of the permit area, <br /> the District 23 Water Commissioner determined that any movement of the ditch like that <br /> prescribed in the technical revision would not impact any downstream water users on this ditch. <br /> The revised Reclamation Plan Map shows the relocated Platte City Ditch will <br /> contain three sharp turns which are nearly 90°. The Applicant must demonstrate the <br /> proposed alignment of the ditch hill not lead to excessive erasion or potential of- <br /> site impacts due to the water flowing outside of the designed channel. The Division <br /> recommends removing anv sharp turns from the proposed alignment of the ditch. <br /> Sharp turns have been removed from the proposed ditch alignment. <br /> 8. The revised Reclamation Plan Map contains a label in Phase lA which states <br /> "Pond and Ditch Maintenance Access to Remain Following Reclamation". This <br /> label does not seem to apply to the revised Reclamation Plan. Please clarify the <br /> intent of'the label or remove it from the revised Reclamation Plan Map. <br /> The label has been removed. <br /> Fairplay Au TR07 2 <br />
