t � , <br /> Page 3 <br /> Mr. Eric Scott <br /> September 29, 2017 <br /> (a)Locate on a map(in Exhibit C)tributary water courses, wells springs, stock water ponds, reservoirs, and <br /> ditches on the affected land and on adjacent lands where such structures may be affected by the proposed <br /> mining operations. - The required geological attributes are shown on the maps. <br /> At this time, the figures submitted show at least 4 groundwater wells on or adjacent to the permitted area. <br /> The text provided does not identify or provided any information for any of these wells, and in fact, list a well <br /> ID that does not appear to be shown on the provided map at this time. Please revise for completeness and <br /> consistency between text and maps. - There was some incorrect information the original maps. The <br /> information shown on the maps has been updated. The wells surrounding the Site via a search on <br /> the Division of Water Resources website show the following wells. <br /> - Permit 1244775- "old"domestic well owned by the L ee's(currently permitted for mining) <br /> - Permit 150985--MH-Monitoring well located on the Serfer Pit <br /> Permit#78322-F-Gravel Pit Permit Well(N/A) <br /> Permit#12168--R-irrigation well north or the North La Poudre Mine Site <br /> EXHIBIT L -Reclamation Costs(Rule 6.4.12):(1)All information necessary to calculate the costs of <br /> reclamation must be submitted and broken down into the various major phases of reclamation. You must <br /> provide sufficient Information to calculate the cost of reclamation that would be incurred by the state. <br /> The current bond for the site was calculated for reclamation of all exposed groundwater utilizing the <br /> previous DRMS policy of bonding for 20%of the total slurry wall cost utilizing a$'3 per sq ft rate for <br /> estimating total slurry wall installation costs. This policy has been rescinded and the permitee will now be <br /> required to submit financial warranty for the full cost of lining or backfilling as appropriate for the approved <br /> reclamation plan. This should also include cost for installation of appropriate flood control structures for <br /> reservoir in the flood plain. -The current bond is$915,820. The recalculated bond is$1,274,808.52. <br /> See attached Table. <br /> Please provide a detailed reclamation estimate including tasks and unit rates for completing the reclamation <br /> as proposed in Exhibits E and F. In addition to grading, topsoil replacement, and revegetation, this estimate <br /> shall include costs for draining,re-sloping, fully lining or backfilling all exposed groundwater areas, and <br /> installation of flood control structures as appropriate. If the SEO has approved the liner for the eastern <br /> "slurry lined pond"please provide a copy of the approval documentation. -See updated Table and <br /> attached documentation. <br /> EXHIBI T S-Permanent Man-Made Structures(Rule 6.4.19):Please note that roadways and abo ve-ground <br /> or underground utilities(if present)within 200 feet of the proposed affected area are considered permanent <br /> man-made structures. In accordance with Rule 6.4.19, when mining operations will adversely affect the <br /> stability of any significant, valuable and permanent man-made structure located within 200 feet of the <br /> affected area, the applicant may either. <br /> a.)Provide a notarized agreement between the applicant and the person(s)having an interest in the <br /> structure, that the applicant is to provide compensation for any damage to the structure;or-The notarized <br /> agreements have all been mailed to all structures owners to best of the permitees knowledge. An <br /> engineering analysis has also been performed. See attached letter. <br /> b.) Where such an agreement cannot be reached, the applicant shall provide an appropriate engineering <br /> evaluation that demonstrates that such structure shall not be damaged by activities occurring at the mining <br /> operation. -The ponds have been reclaimed for at least 15 years. The only pond remaining <br /> reclamation is the"Wildlife Pond",this pond is finished mining and has been like this for at least 3 <br /> to 4 years. There has been no negative impacts to surrounding structures and has withstood a <br /> significant flood in 2013. <br />
