The Division has further determined that at a level of 90,909,000alg limper year of diesel and 165,300 <br />gallons ,year of gasoline usage uncontrolled emissions from these emission points would equal two tons <br />per year each. At this level an APEN would then be required. <br />The source has not increased throughput such that they approach the extremely high limits (underlined <br />above) which would nullify this Exemption Letter. Therefore, the source is in compliance and this point <br />shall remain APEN Exempt. <br />Permit Number 09GU1382 — Underground coal mining and processing equipment, as described in Attachment <br />A of the permit. The Initial Approval version of this permit was issued on June 18, 2010. This initial approval <br />permit combined previous individual equipment permits and included Initial Approval requirements for the <br />proposed coal prep plant. The source completed all Initial Approval requirements (i.e. Conditions 1 through 3) <br />prior to the 2012 inspection. The Final Approval authorization letter for this permit was issued on 3/11/2016 (not <br />in effect at the time of the 2015 inspection). <br />Within one hundred and eighty days (180) after commencement of operation, compliance with the <br />conditions contained on this permit shall be demonstrated to the Division. It is the permittee's <br />responsibility to self certify compliance with the conditions. Failure to demonstrate compliance within <br />180 days may result in revocation of the permit. (Information on how to certify compliance was mailed <br />with the permit.) <br />The source submitted all required self -certification documents on 12/14/2010, within 180 days after <br />commencement of operation of equipment which had been installed up to that point. Further self - <br />certification documents were later submitted on 8/29/2011 following the installation of the prep <br />plant crusher. The source followed all requirements of self -certification appropriately and is in <br />compliance with this condition. <br />This permit shall expire if the owner or operator of the source for which this permit was issued: (i) does <br />not commence construction/modification or operation of this source within 18 months after either the date <br />of issuance of this initial approval permit or the date on which such construction or activity was scheduled <br />to commence as set forth in the permit application associated with this permit; (ii) discontinues <br />construction for a period of eighteen months or more; or (iii) does not complete construction within a <br />reasonable time of the estimated completion date (See General Condition No. 6., Item 1.). Upon a <br />showing of good cause by the permittee, the Division may grant extensions of the permit. (Reference: <br />Regulation No. 3, Part B, Section III.F.4.) <br />The source constructed the prep plant and began operation within the time periods required <br />following the issuance of this permit. According to the submitted `Notice of Startup', the prep plant <br />began operation on 9/24/2010. Source is in compliance. <br />Within one hundred and eighty days (180) after commencement of operation, the applicant shall submit to <br />the Division for approval an operating and maintenance plan for all control equipment and control <br />practices, and a proposed record keeping format that will outline how the applicant will maintain <br />compliance on an ongoing basis with the requirements of condition no.7 listed below. The operating and <br />maintenance plan shall commence at startup. (Reference: Regulation No. 3, Part B, Section III.G.7.) <br />The Division received and approved the source's updated O&M plan on 8/25/2011 and 10/14/2011 <br />respectively.
