PERMIT#: M-1985-026 <br /> INSPECTOR'S INITIALS: ECS <br /> INSPECTION DATE: October 12,2017 <br /> INSPECTION TOPIC: Gen. Compliance With Mine/Reclamation Plan <br /> PROBLEM/POSSIBLE VIOLATION: Problem: Failure to follow approved reclamation plan, or current reclamation <br /> plan needs to be updated and clarified pursuant to C.R.S. 34-32.5-116 (1). The operator must follow approved <br /> reclamation plan or provide sufficient information to describe or identify how the operator intends to conduct <br /> reclamation. In this instance, the construction of a private residence within the north end of the permit area will <br /> need to be added to the reclamation plan. <br /> CORRECTIVE ACTIONS:The operator shall submit a Technical Revision, with the required $216 revision fee, to <br /> update and clarify the current approved reclamation plan to reflect existing and proposed activities by the <br /> corrective action date. <br /> CORRECTIVE ACTION DUE DATE: 12/29/17 <br /> OBSERVATIONS <br /> This was a routine inspection for the Challenger Pit conducted by DRMS representative Eric Scott. DRMS met <br /> the Operator Representative, Ken Coulson at the northern site entrance off County Rd 54 then toured the site. <br /> The site identification sign was observed at the site entrance (photo 1), and the permit area is defined by <br /> established fencing. <br /> The following compliance issues were noted during the inspection and will need to be addressed by the <br /> corrective action dates listed above (December 29, 2013). <br /> 1) The site has been inactive since 2003, however the permit cannot be released because the permanent <br /> augmentation plan for the three exposed groundwater ponds located in the north half of the site has <br /> not yet been filed with the Division of Water Resources. The permittee will also need to demonstrate <br /> by the corrective action date that a valid substitute water supply plan is in effect for the exposed <br /> groundwater within the permit area. <br /> 2) Structures have been built within the permit area that are not part of the approved reclamation plan <br /> (private residence and several boat docks). This issue was also noted in the previous 2013 inspection <br /> report. <br /> Other than the compliance issues noted above, the reclamation of the site is essentially completed. There is <br /> one area of vegetation between pond 1 and pond 3 that will require some additional attention (photo 3), but <br /> the remainder of the site is in releasable condition at this time (photos 2, 4-6). <br /> At this time DRMS would support a partial release request for the southern portion of the site which does not <br /> contain any areas of exposed groundwater, and is currently being utilized as grazing area and wildlife habitat <br /> as seen in the attached photos. <br /> Page 2 of 4 <br />
