OPERATORS <br /> SHOULD READ THE FOLLOWING PAGES CAREFULLY IN ORDER TO ASSURE COMPLIANCE <br /> WITH THE TERMS OF THE PERMIT AND APPLICABLE RULES AND REGULATIONS. If a <br /> Possible Violation is indicated, you will be notified under separate cover as to when the Mined Land <br /> Reclamation Board will consider possible enforcement action. <br /> INSPECTION TOPIC: Reclamation Success <br /> PROBLEM/POSSIBLE VIOLATION: Problem: Section 34-32.5-116(4)(q)(1) of the Colorado Land Reclamation Act <br /> for the Extraction of Construction Materials states that: "... final reclamation of each mining phase shall be <br /> completed prior to the expiration of five years after the date the operator advises the board in an annual report <br /> that such phase of mining has been completed..." The most recent annual reports state that mining ceased in <br /> 2003, however, this site cannot be released at this time because the operator still has not filed a permanent <br /> augmentation plan with the Division of Water Resources for the exposed groundwater ponds located within the <br /> permit area. <br /> CORRECTIVE ACTIONS: Submit to DRMS no later than December 29, 2017 proof of a valid substitute water <br /> supply plan and a schedule for the submittal to the State Engineer's Office a permanent augmentation plan for <br /> the three exposed groundwater ponds located on the northern portion of the permit area. <br /> CORRECTIVE ACTION DUE DATE: 12/29/17 <br /> Page 1 of 4 <br />
