section 34-32-103(6)(a)(III), C.R.S., an operator may be in temporary cessation of <br />production of up to ten years. <br />18. Under Rule 1.13.8(1)(a) and (b) of the Mineral Rules and Regulation of the <br />Colorado Mined Land Reclamation Board for Hard Rock, Metal, and Designated Mining <br />Operations ("Rules"), a permit shall continue in effect as long as the mining operation is <br />resumed within five years of the beginning of Temporary Cessation or the operator files <br />a request for the extension of the period of Temporary Cessation and secures Board <br />approval of such request. <br />19. Rule 1.13.2 sets forth Indications of Temporary Cessation, including that <br />"there are no personnel working at the site for one hundred eighty consecutive days," <br />"there is no sale or processing of material," and "mine development has ceased and <br />mining has not recommenced." Rule 1.13.2(1), (5), and (7). The site meets indications <br />set forth in Rule 1.13.2. <br />20. Rule 1.13.3 sets forth Indications Against Temporary Cessation, including <br />that "[e]xtraction of minerals has been completed and only final reclamation and related <br />activities occurring at the site are part of the `life of the mine"' and "a permit has been <br />issued, but the mining operation has not commenced." Rule 1.13.3(1) and (2). The site <br />does not meet the indications set forth in Rule 1.13.3. <br />21. Rule 1.13.5(3)(c) requires a notice for a second period of Temporary <br />Cessation to include, among other things, demonstration of continued commitment to <br />conduct mining operations at the site by the end of the second five-year period. <br />Operator's investigation into another mining method, specifically ablation, indicates <br />Operator's commitment to conduct mining operations at the site within the next five year <br />period. <br />22. Operator complied with the notice of for the second period of Temporary <br />Cessation as set forth in the Act and Rules. <br />ORDER <br />Based on the foregoing findings of fact and conclusions of law, the Board hereby <br />GRANTS the request of Pinon Ridge Mining, LLC for a second period of Temporary <br />Cessation.
