6. On March 6, 2014, the Division approved the first period of Temporary <br />Cessation ("TC -1") for the site, with an effective date of June 13, 2012. <br />7. On October 21, 2014, the Division approved Succession of Operator SO - <br />03 for the permit, transferring it from Energy Fuels Resources, Inc. to Operator. <br />8. On April 14, 2017, the Division sent written notice to Operator that TC -1 <br />would expire on June 13, 2017. <br />9. On May 30, 2017, the Division received a request for a second period of <br />Temporary Cessation ("TC -2") for the site. <br />10. The Division conducted a normal monitoring inspection of the site on June <br />12, 2017. A representative of the U.S. Bureau of Land Management ("BLM") attended <br />the inspection. During the inspection, the Division observed, among other things, <br />adequate mine signage; two metal buildings, including a hoist house and shop; the mine <br />shaft, which was observed to be secured with grating welded to the collar; and a vent <br />hole that was secured with grating welded to the fan assembly. The Division found no <br />problems or violations at the site during the inspection. <br />TC -2. 11. On June 23, 2017, Objectors filed a written objection to the request for <br />12. On July 20, 2017, the Division received a letter of support for the request <br />for TC -2 from WSMA. <br />13. The Division holds a financial warranty for the site in the amount of <br />$75,057. The financial warranty is adequate to reclaim the site. <br />14. At the hearing, Mr. Siglin testified on behalf of Operator that minerals have <br />not been extracted from the site because the recent and current market price of uranium <br />makes extraction unprofitable. Mr. Siglin also testified that Operator is investigating the <br />use of ablation to produce minerals at the site and, to that end, has sought a <br />determination from the Colorado Department of Public Health and Environment of <br />whether a permit would be required before Operator could use ablation to extract <br />minerals from the site. <br />15. The Division does not support Operator's request for TC -2. <br />CONCLUSIONS OF LAW <br />16. The Board has jurisdiction over this matter pursuant to the Mined Land <br />Reclamation Act, Article 32 of Title 34, C.R.S. ("Act"). <br />17. Under section 34-32-103(6)(a)(II), C.R.S., an operator may temporarily <br />cease production upon compliance with the notice requirements therein.
