16. Change of Water Rights and Plan for Augmentation Contemplated by Law: <br />The change of water rights and plan for augmentation decreed herein are <br />contemplated by law and satisfy the requirements of sections 37-92-101 et seq. <br />C.R.S. The change of water rights and plan for augmentation will not injuriously <br />affect any owner of or person entitled to use water under a vested water right or <br />decreed conditional water right, so long as operated and administered in accordance <br />with the terms of this Decree. <br />17. Rule 4.29 of the Proposed Rules defines "Sustainable Water Supply" as "a <br />supply of groundwater that is being managed in accordance with sections 37-92- <br />501(4)(a)(1) through (111), C.R.S." This plan for augmentation includes a method or <br />standard for determining, achieving, and maintaining a Sustainable Water Supply. <br />The Applicant has demonstrated that this plan for augmentation reliably determines <br />the Sustainable Water Supply and is sufficient to achieve and maintain a <br />Sustainable Water Supply. This plan for augmentation completely replaces all future <br />aquifer depletions with fully consumable water, thus achieving a Sustainable Water <br />Supply on a continuous basis. Tributary groundwater is not used for any portion of <br />the augmentation supply. <br />18. The plan for augmentation decreed herein meets all applicable requirements of <br />the Proposed Rules Governing the Withdrawal of Groundwater in Water Division No. <br />3 (the Rio Grande Basin) that were filed by the State Engineer and published in the <br />September 2015 resume for Water Division No. 3 in Case No. 15CW3024. <br />RULING OF THE REFEREE <br />19. Incorporation: The foregoing findings of fact and conclusions of law are <br />incorporated by this reference and modified as necessary to constitute the ruling of <br />the referee and decree of the Court. <br />20. Approval: The Court hereby approves the change of water rights and plan for <br />augmentation described herein, subject to the terms and conditions of this Decree. <br />21. Terms and Conditions: The terms and conditions of this decree are adequate <br />to assure that operation of the change of water rights and plan for augmentation <br />described herein will not injuriously affect any owner of or person entitled to use <br />water under a vested water right or decreed conditional water right. <br />22. Well Permit: The Applicants shall submit a well permit application to the Office <br />of the State Engineer to re -permit Well No. Aug 1 in accordance with the terms and <br />conditions of this Decree. <br />23. Measuring Devices: To the extent not already in place, Applicants shall install <br />and properly maintain measuring and recording devices as are required by the State <br />and/or Division Engineers for administration of this Decree. To measure water <br />withdrawn from Well No. Aug. 1, the Applicants shall install measuring devices in <br />compliance with the Rules Goveming the Measurement of Ground Wafer Diversions <br />0013'-4 <br />44 Summit Engineering Job Number: 1707122CE 36 <br />719-589-6147 <br />Alamosa, CO <br />
