Sediment demonstrations <br />were previously provided and approved in SL -09. <br />Summary and Conclusions <br />Based upon a review of the mine permit, the applicant's bond release application, and site inspections, <br />the Division finds that Snowcap Coal Company, Inc has successfully completed all surface coal mining <br />reclamation operations in accordance with the approved reclamation plan and met all requirements of the <br />Act and the Rules on the 4.0 acres requested for final release in this SL -10 application. <br />IV. PROPOSED DECISION <br />Based on the observations above, the Division proposes to approve Snowcap Coal Company, Inc's <br />request for a partial Phase III bond release for the Roadside Portals. This proposed decision will release <br />the applicant from liability for all reclamation work on the remaining 4.0 acres at the Roadside North <br />portal and all lands west of the Colorado River. <br />PHASE III <br />The original performance bond for the Roadside Portals was $1,500,000.00. The Reclamation Liability <br />prior to any bond release approvals was $3,264,149.00 (8/8/2002).
