Colorado Springs Utilities <br /> It's how we're all connected <br /> grade of the mines. In order to use inert, non-putrescible material as backfill, the El Paso County Land <br /> Development Code and the Colorado Department of Public Health and Environment(CDPHE) Regulations <br /> Pertaining to Solid Waste Sites and Facilities required that the fill activities be permitted as a solid waste <br /> landfill. <br /> The CSR Solid Waste Certificate of Designation (CD) issued by El Paso County serves as the permit for <br /> the CSR solid waste disposal sites. In 2004, Utilities amended the CSR CD to include, among other things, <br /> placement of inert non-putrescible materials within Gravel Pit#2 as part of the mine reclamation activities6. <br /> The amended CD, CD-004-001,was approved by both El Paso County'and the CDPHE8. In 2009, Utilities <br /> requested approval from the CDPHE to begin the placement of inert, non-putrescible materials within <br /> Gravel Pit#2 pursuant to CD-004-001 and Mining Permit Technical Revision TR-39. Utilities also requested <br /> a waiver from the requirement to line the landfill and conduct groundwater monitoring based on the inert <br /> nature of the fill material and the site's hydrogeologic characteristics10. Eight boreholes were installed in <br /> the proposed placement area to support the waiver request (the borehole logs are attached to this letter). <br /> The CDPHE subsequently approved both the placement request and the waiver request in a letter dated <br /> May 4, 200911 (attached). The CDPHE copied the Colorado Division of Reclamation and Mining Safety on <br /> their approval letter. After receipt of the CDPHE's approval, Utilities began the placement of inert, non- <br /> putrescible fill material within Gravel Pit#2. The Landfill's CDPHE approved12 Operations Plan includes <br /> provisions for stormwater control, material characterization, cover, and closure. The fill placement <br /> continues under the oversight of El Paso County and the CDPHE Hazardous Materials and Waste <br /> Management Division.
