Decree <br /> Case No. 04CW6 <br /> Pond to the Division Engineer and the opposers in this case. In the event that the <br /> Applicant elects to construct the Storage Pond, the Applicant shall replace all <br /> historical return flows and depletions from evaporative and operational losses and <br /> comply with all terms and conditions set forth in subparagraphs 25.1 through 25.7 <br /> below. <br /> 25.1. Replacement of Surface return flows. The Applicant shall measure and <br /> immediately return 25 percent of its daily farm headgate deliveries <br /> attributable to the Water Rights to the Cache la Poudre River through a ditch <br /> or pipe located as shown on Exhibit B for the replacement of historical <br /> surface water return flows. Applicant shall measure and store the remainder <br /> of the farm headgate deliveries (75%)attributable to the Water Rights in the <br /> Storage Pond for replacement of historical groundwater return flows and <br /> evaporative and operational losses by measured release from the Storage <br /> Pond directly to the Cache la Poudre River as described in the <br /> subparagraphs below. <br /> 25.2. Replacement of Depletions. The Applicant shall divide the monthly lagged <br /> depletions from operational and evaporative losses in Table 7 by the number <br /> of days in the corresponding month and that volume shall be measured and <br /> released to the Cache la Poudre River from the Storage Pond daily. <br /> 25.3. Replacement of Lagged Return Flows. The Applicant shall calculate its <br /> monthly lagged historical groundwater return flow obligations by <br /> multiplying the groundwater return flow factors in Table 9 below by the <br /> total annual farm headgate deliveries from the previous year. Storage Accounting Obligation. In addition to the measurement and <br /> accounting requirements of paragraph 34 below,the Applicant shall account <br /> for all measured and unmeasured inflows and outflows for the Storage Pond <br /> on a daily basis and report on a monthly basis all accounting for Storage <br /> Pond to the Division Engineer using accounting forms approved by the <br /> Division Engineer. The Applicant shall install and properly maintain such <br /> other measuring devices and recorders to determine measurable inflows, <br /> measurable outflows, and water surface area and storage volume acceptable <br /> 11 <br />
