Decree <br /> Case No. 04CW6 <br /> AUGMENTATION PLAN <br /> 16. Structures and Groundwater Losses to be Augmented. Depletions to the Cache la <br /> Poudre River from evaporation of exposed groundwater from the Deep Pond and <br /> Timnath Pit, as shown on Exhibit B,will be replaced pursuant to the <br /> Augmentation Plan approved in this decree. In addition, depletions caused by <br /> consumptive use of groundwater from the Timnath Pit associated with removal of <br /> aggregate material and groundwater pumped for mining operations, such as dust <br /> control and washing will be augmented. <br /> 17. Source of Augmentation Water. The Water Rights changed pursuant to this decree <br /> shall be used for augmentation. <br /> 18. Manner of Augmentation and Replacement. Unless otherwise selected according <br /> to the provisions of Paragraph 25,the Augmentation Plan will use the Recharge <br /> Pit to be located on the Property at 40' 29' 56"N 104' 58' 39"W, as shown on <br /> Exhibit B to replace depletions from mining operations and evaporation at the <br /> Timnath Pit and historical subsurface return flows pursuant to the change of the <br /> Water Rights approved in this decree. The Recharge Pit shall be located on the <br /> Kehn Property so that deliveries to the Recharge Pit will replace historical <br /> subsurface return flows and evaporative/mining depletions in time, place and <br /> amount to prevent injury to other water rights. <br /> 19. Calculation of Exposed Groundwater Evaporation. Applicant shall limit the <br /> surface area of exposed groundwater on the Kehn Property, including the Deep <br /> Pond and Timnath Pit shown on Exhibit B to a total of no more than 25 acres at <br /> all times. Applicant shall record monthly the exposed surface area of the Timnath <br /> Pit and the Deep Pond to ensure compliance with the foregoing requirement. <br /> Table 3 Net Evaporation Rate (acre-feet/acre) <br /> Jan Feb Mar Apr May Jun Jul Aug Sep Oct Nov Dec total <br /> 0.08 0.09 0.11 0.20 0.24 0.37 10.39 0.38 0.26 0.17 10.09 0.07 2.45 <br /> The monthly net evaporation rate per acre of exposed groundwater is shown in <br /> Table 3 above.
