Decree <br /> Case No. 04CW6 <br /> delivers water to the Kehn Property. <br /> 15.2. Seasonal Limitation. Kehn shall limit its diversion of the Water Rights to <br /> the period from April 1 to October 31 in each year. <br /> 15.3. Maximum Delivery Limits. Long-term Delivery Limits. The Applicant shall limit its future deliveries to <br /> the farm headgate on a cumulative basis during any 30-year period to <br /> 8,557.5 acre-feet. To comply with this provision,the Applicant shall assume <br /> that the farm headgate deliveries for the previous 29 years prior to entry of <br /> this decree total 8,209 acre-feet(historical deliveries during 1961-1989 as <br /> shown in Exhibit A). <br /> 15.5. Cessation of Irrigation. Kehn shall cease use of the Water Rights for <br /> irrigation on the Kehn Property. In addition,the Kehn Property shall not be <br /> irrigated with any other Box Elder Ditch shares without separate water court <br /> approval. <br /> 15.6. Historical Return Flow Maintenance. The surface and subsurface return <br /> flow obligations should be replaced daily at times when there is a valid call, <br /> including exchanges, originating from water rights downstream from the <br /> Kehn Property. Applicant shall replace the historical surface return flows <br /> by delivering water attributable the Water Rights directly to the Cache la <br /> Poudre River in a pipe or ditch to be located approximately as shown on <br /> Exhibit B. Such replacement water shall be delivered to the Cache la Poudre <br /> River, and not be delivered to any wetlands on the Kehn Property. Applicant <br /> shall deliver 25% of the daily diversions attributable to the Water Rights <br /> directly to the Cache la Poudre River to meet the surface return flow <br /> obligation. The remainder of the daily diversions attributable to the Water <br /> Rights shall be delivered to a dedicated recharge pit or storage pond to be <br /> constructed on the Kehn Property as described in the Augmentation Plan <br /> below to meet the lagged subsurface return flow obligations and <br /> augmentation requirements. <br /> 15.7. Wetlands. The Water Rights shall not be delivered to, or used in any way for <br /> the creation or mitigation of,wetland areas on or around the Kehn Property. <br /> 5 <br />
