6/5/2017
State.co.us Executive Branch Mail - Fwd: Bowie No. 1 Mine PR -05
Mr. Yeager is a contractor for the Delta County Board of Commissioners. This was a response email that I sent to him
after he asked me about the Bowie No 1 PR -5.
Clayton Wein
Environmental Protection Specialist
'A
---------- Forwarded message ----------
From: Wein - DNR, Clayton <clayton,weina@state.co.us>
Date: Mon, May 22, 2017 at 3:48 PM
Subject: Bowie No. 1 Mine PR -05
To: kyeager@deltacounty.com
Cc: Jim Stark - DNR <jim,stark@state.co.us>, DNR DRMS_CoalAdmin - DNR <dnr—drms—coal—admin@state.co.us>
Good afternoon Mr. Yeager,
Here is the information that you requested during our phone conversation earlier today regarding the Loadout for the
Bowie No. 1 Mine. If you have any questions, feel free to contact me at (303)-866-3567 x8144 or at
clayton.wein@state.co.us.
The Bowie Resources, LLC (BRL), Bowie No. 1 Mine's Permit Revision 05 (Division File No.C-1981-038). This permit
revision is proposing a change in post -mining land -use at the Bowie No. 1 Mine's loadout facility from the currently
approved land -use of cropland to a new land -use of industrial or commercial. The Division received BRL's PR -05
application on 11/1/2016, deemed it complete on 3/24/2017, and is currently reviewing the application for technical
adequacy. Below are the answers to the questions you posed in your 4/25/2017 and 4/26/17 emails.
Temporary and permanent land -use changes are approved at the county level. The Division does not have any
regulatory authority over land -use changes and does not dictate county land -use. Following a county land -use change at
a mine site, an operator must submit a Permit Revision to reflect that change. With the submittal of PR -05, BRL is
starting the Division's required process in anticipation of the county approving the land -use change. The Division,
however, will not approve a land -use change unless and until the county approves such a change. At that point, the
Division must approve the land -use change in the mine's permit. If the county does not approve the proposed land -use
change, the Division will not approve PR -05.
Even if the county approves a land -use change at the Bowie No. 1 Mine's loadout area, the lands would still be under the
Division's jurisdiction until BRL applies for and successfully receives final bond release and termination of jurisdiction. If
the county approves an alternate post -mining land -use of industrial or commercial, the Rules (specifically Rule 3.03.1(3)
https://m ai I . googl e. com/mail/b/511 /u/0/?ui =2&i k=deb7fOcd2O&view= pt&search= i nbox&th=15c45a l 5d2dac3f9&si m I=15c45al 5d2dac3f9 1/2
