regulations at 43 CFR 3600 pursuant to the Materials Act of July 31, 1947, as amended, (30 <br /> United States Code [U.S.C.] 601, et. seq.) (Materials Act). <br /> Based on the analysis contained in this EA, the BLM will decide whether to approve or deny the <br /> proposed mineral material free use permit, and if so, under what terms and conditions. Under the <br /> National Environmental Policy Act (NEPA), the BLM must determine if there are any significant <br /> environmental impacts associated with the Proposed Action warranting further analysis in an <br /> Environmental Impact Statement(EIS). The Field Manager is the responsible official who will <br /> decide one of the following: <br /> • To approve the mineral materials free use permit either under the same conditions or a <br /> modified version of those conditions; <br /> • To analyze the effects of the Proposed Action in an EIS; or <br /> • To deny the mineral materials free use permit. <br /> The Proposed Action is subject to and in conformance (43 CFR 1610.5) with the following land <br /> use plans: <br /> Land Use Plan: Kremmling Record of Decision and Approved Resource Management Plan <br /> (ROD/RMP) <br /> Date Approved: June 19, 2015, amended September 2015 <br /> Decision Language: "Facilitate environmentally sound exploration and development of <br /> locatable minerals, mineral materials, and non-energy leasable minerals." (ARMP Chapter 2, <br /> page 67). <br /> Land Use Plan: Northwest Colorado Greater Sage-Grouse Approved Resource Management <br /> Plan Amendment <br /> Date Approved: September 2015 <br /> Decision Language: "MD MR-17: (PHMA) Close PHMA to new mineral material sales. <br /> However,these areas would remain open to free use permits and the expansion of existing <br /> active pits, only if the following criteria are met: <br /> • The activity is within the biologically significant unit and the project area disturbance cap <br /> • The activity is subject to the provisions set forth in the mitigation strategy (Appendix F) <br /> • All applicable required/preferred design features are applied; and [if applicable] the <br /> activity is permissible under the regional screening criteria(Appendix H, Guidelines for <br /> Implementation and Adaptive Management)."
