gown OF---�- <br /> WINDSOR <br /> COLORADO <br /> May 24, 2017 <br /> Division of Reclamation, Mining and Safety <br /> Attn: Eric Scott <br /> 1313 Sherman Street, Room 215 <br /> Denver, Colorado 80203 <br /> Subject: Bestway Concrete &Aggregates—Amendment to North La Poudre Pit M (MLRB <br /> 112)for Construction Materials Operation Reclamation Permit <br /> Dear Mr. Scott: <br /> Thank you for the notification and opportunity to comment on the proposed amendment to this <br /> mining permit. The Town of Windsor and Bestway Concrete &Aggregates (Bestway) have <br /> been in recent contact to discuss the following areas of interest. <br /> Drainage <br /> The subject property is located at the southeast corner of SH 392 (Main Street) and WCR 13 <br /> (County Line Road). There are two (2)culverts under SH 392 approximately 1,175 feet east of <br /> the intersection of SH 392 and WCR 13 that are intended to accept historic drainage of storm <br /> water from the ditch along the north side of SH 392. <br /> The property owners to the north of the subject property (both in Windsor and unincorporated <br /> Weld County) have recently been experiencing occurrences of storm water backing up in the <br /> ditch and onto their properties. It appears as though something may be impeding the historic <br /> flow of storm water through the culverts and the open ditch across the subject property. The <br /> Town is currently working with Bestway to coordinate the removal of any blockage so that storm <br /> water can be conveyed across the property to the Poudre River as historically intended. <br /> Therefore, we respectfully recommend that perpetual maintenance of such drainage facilities be <br /> required as a condition of any amendment to the subject permit. <br /> Streets and Utilities <br /> According to Windsor's Comprehensive Plan, WCR 13 is classified as a Rural Minor Arterial <br /> Road with an ultimate right-of-way width of 65 feet east of the section line. The existing ROW <br /> varies from 35 feet to 45 feet. We respectfully request that the proposed mine area maintain a <br /> minimum 65 feet plus an additional 20 feet for utilities from the section line. <br /> Haul Routes/Truck Traffic/Auxiliary Lanes <br /> Concrete mixer trucks obviously need to be able to deliver concrete to various job sites and <br /> projects; however, the "belly dump"trucks that are currently bringing materials from off-site <br /> locations for processing at the subject property are creating negative impacts on Main Street <br /> (SH 392).
