gown OF---�- WINDSOR COLORADO May 24, 2017 Division of Reclamation, Mining and Safety Attn: Eric Scott 1313 Sherman Street, Room 215 Denver, Colorado 80203 Subject: Bestway Concrete &Aggregates—Amendment to North La Poudre Pit M (MLRB 112)for Construction Materials Operation Reclamation Permit Dear Mr. Scott: Thank you for the notification and opportunity to comment on the proposed amendment to this mining permit. The Town of Windsor and Bestway Concrete &Aggregates (Bestway) have been in recent contact to discuss the following areas of interest. Drainage The subject property is located at the southeast corner of SH 392 (Main Street) and WCR 13 (County Line Road). There are two (2)culverts under SH 392 approximately 1,175 feet east of the intersection of SH 392 and WCR 13 that are intended to accept historic drainage of storm water from the ditch along the north side of SH 392. The property owners to the north of the subject property (both in Windsor and unincorporated Weld County) have recently been experiencing occurrences of storm water backing up in the ditch and onto their properties. It appears as though something may be impeding the historic flow of storm water through the culverts and the open ditch across the subject property. The Town is currently working with Bestway to coordinate the removal of any blockage so that storm water can be conveyed across the property to the Poudre River as historically intended. Therefore, we respectfully recommend that perpetual maintenance of such drainage facilities be required as a condition of any amendment to the subject permit. Streets and Utilities According to Windsor's Comprehensive Plan, WCR 13 is classified as a Rural Minor Arterial Road with an ultimate right-of-way width of 65 feet east of the section line. The existing ROW varies from 35 feet to 45 feet. We respectfully request that the proposed mine area maintain a minimum 65 feet plus an additional 20 feet for utilities from the section line. Haul Routes/Truck Traffic/Auxiliary Lanes Concrete mixer trucks obviously need to be able to deliver concrete to various job sites and projects; however, the "belly dump"trucks that are currently bringing materials from off-site locations for processing at the subject property are creating negative impacts on Main Street (SH 392).
