No operator was present during the inspection. The weather was sunny and <br />ground conditions were dry. Temperatures during the inspection were around eighty degrees fahrenheit. <br />HYDROLOGIC BALANCE - Rule 4.05 <br />Drainage Control 4.05.1, 4.05.2, 4.05.3; Siltation Structures 4.05.5, 4.05.6; Discharge Struc tures 4.05.7, 4.05.10; <br />Diversions 4.05.4; Effluent Limits 4.05.2; Ground Water Monitoring 4.05.13; Surface Water Monitoring 4.05.13; <br />Drainage – Acid and Toxic Materials 4.05.8; Impoundments 4.05.6, 4.05.9 ; Stream Buffer Zones 4.05.18: <br />The Magpie Diversion Ditch was inspected. The ditch was stable and armored with rip rap along the base of the <br />channel. As noted in previous inspections, maintenance has been requested by the Division multiple times and has <br />yet to be completed. The side embankment is devoid of rip rap and needs to be armored as approved by the permit. <br />No erosion was observed along the devoid area or the remaining area of the ditch. <br /> <br />Magpie Diversion Ditch. <br />GENERAL MINE PLAN COMPLIANCE: <br />The Division has found Energy Fuels Coal, Inc. not in compliance of the Color ado Surface Coal Mining <br />Reclamation Act and Regulations of the Colorado Mined Land Reclamation Board for Coal Mining. A total of <br />three violations are being issued with this report.
