L. Access Roads <br />Under the definition of Access Roads provided in Section 1.04 of the Rules, there are no access <br />roads on the site. There is one Light Use Road in the permit area. The 5t' Street Road is a light <br />use road since mine personnel do not use the road every day. <br />M. Light -Use Roads <br />At the New Horizon Mine, light -use roads will only be used on an intermittent basis for purposes <br />other than transportation of coal including, but not limited to, roads used for monitoring and <br />periodic maintenance of monitoring facilities and reclamation areas, intermittent equipment <br />passage from one mine area to another mine area, or other occasional use. The only road that <br />meets this criteria at the mine site is the 5t' Street Road. This road is occasionally used to <br />monitor wells, Pond 007 and the mine discharge into Calamity Draw. <br />In the New Horizon Mine area, there is a single lane dirt road approximately 0.57 miles long <br />which extends to the west of 5th Street Light Use Road (see Map 2.05.3(3)-8). This road is used <br />by the City of Nucla for access to the city sewage lagoon and to one residence. Alternative <br />access has been provided as required by the Montrose County Commissioners. The Montrose <br />County Commissioners granted Peabody (and by succession, New Horizon) permission to <br />temporarily close this road during mining (see Attachment 2.05.3(3)-8, County Agreement). <br />New Horizon will reopen the road to meet or exceed the terms of the Montrose County Road <br />Closure Agreement. <br />All criteria listed below are utilized in the construction of the 5' Street Road. <br />1. General Requirements <br />New Horizon will construct, maintain and reclaim light -use roads to minimize erosion and <br />siltation, air and water pollution and damage to public and private property. To the extent <br />possible, using the best technology currently available, light -use roads will not cause damage to <br />fish, wildlife, or related environmental values and will not cause additional contributions of <br />suspended solids to stream flow or to runoff outside the permit area. Any such contribution shall <br />not be in excess of limitations of State or Federal law. <br />The light -use roads at the mine site will be designed with appropriate ditches, grades, and <br />culverts to control erosion and runoff. All light -use roads will be constructed basically "on - <br />grade" and the location will be partially limited by the grades of the existing or post mining <br />areas. Stream fords will not be used during construction of roads unless approval is first obtained <br />from the regulatory authority. <br />Section 2.05.3(3) Page 31 February 2017 (TR -78) <br />
