Application of Grand Junction Concrete Pipe Co.et al. <br /> Case No.03CW75 <br /> Ruling of Referee and Decree <br /> Page 3 <br /> The estimated total maximum depth of the Pit will be twenty-five feet, with the water table <br /> generally being located at a depth of approximately 10 feet below the ground surface. <br /> 7. Appropriation Information: The appropriation was initiated on February 18, 1993, by the <br /> Company's filing of a Succession of Operator Application with the Division ofMinerals and <br /> Geology of the Colorado Department of Natural Resources for Permit No. M-80-080, <br /> together with the planning of mining activities and the physical inspection of the property <br /> upon which the mining activities are to occur and the formation of the intent to appropriate <br /> water as described herein. <br /> 8. Amount claimed:Applicants claim 24.3 acre feet per year for evaporation losses(estimated <br /> at 36.47 inches, or 3.04 acre feet per acre), 2.8 acre feet per year for dust control purposes <br /> (15,000 gallons per day),and 2.8 acre feet per year for uses at the batch plant(15,000 gallons <br /> per day). In addition, Applicants claim 2.2 acre feet per year for product moisture loss . <br /> Product moisture losses were calculated at the rate of 4%of the material that will be mined es <br /> below the water table, with Applicants estimating that approximately 75% of the 100,000 <br /> tons projected to be mined, or 75,000 tons, will be located below the water table. All of <br /> these uses are considered to be 100%consumptive for a total of 32.1 acre feet on an annual <br /> basis. The allocation of these uses in any given year may change, so long as the total <br /> consumptive use for that year does not exceed a total of 32.1 acre feet. Finally, water will <br /> be pumped from the Pit at the maximum rate of 800 <br /> water not used for dust control and batch plant uses being Pumped dirp crposes tlly back with <br /> he <br /> Colorado River. The water pumped back to the Colorado River for dewatering purposes will <br /> be non-consumptive. All amounts are claimed conditional. <br /> 9. Pro osed Uses: Industrial uses, including but not limited to evaporation during mining <br /> activities and after completion of mining activities from the pond referred to in Paragraph <br /> 11,below,dust suppression,batch plant uses,and product moisture losses through aggregate <br /> removal and processing, all in connection with the mining of sand, gravel, and related <br /> products from the land on which the Pit is to be located(the"Pit Property"). These uses will <br /> be made in accordance with the Plan for Augmentation,described below,when required to <br /> satisfy a valid call, <br /> 10. Name and Address of Owner of Land on Which Structures are Located: The Pit Property is <br /> owned by Co-Applicants, Ronald Tipping, Marie Tipping,Bill Patterson, and Rod Power <br /> (the"Owners'). The location of the Pit Property,including portions thereof that will not be <br /> involved in the proposed mining operations, is shown in the attached Figure 1. <br />
