Additional Landlord Covenants. <br /> A. Landlord covenants that she has good title to the Property and the material to <br /> be removed from the Property, and warrant and will defend the title to the <br /> Property and material. Furthermore,Landlord will indemnify Tenant against <br /> any and all claims, demands, suits, liabilities, damages, losses, costs and <br /> expenses (including reasonable attorney fees) arising from or related to any <br /> lien, encumbrance, restriction, or defect in the title to the Property and <br /> material. In the event the holder of any lien or encumbrance against the <br /> Property commences foreclosure proceedings against the Property, Tenant <br /> shall have the right, but not the obligation, to make any cure or redemption <br /> payments to stop foreclosure. In such case, all sums paid by Tenant to stop <br /> foreclosure shall be credited against sums Tenant then owes or may in the <br /> future owe to Landlord pursuant to this Lease. <br /> 18. Attorney Fees. In the event of a dispute between the parties regarding this Lease, <br /> the Property,or the Sand, Gravel and Aggregate Mine which results in litigation, the <br /> prevailing party shall be awarded its court costs and reasonable attorney fees in <br /> connection with such dispute. <br /> 19. Miscellaneous. <br /> A. This Lease shall inure to the benefit of and shall be binding on the heirs,legal <br /> representatives, successors and assigns of the parties. <br /> B. Time is of the essence in all provisions of this Lease. <br /> C. This Lease shall be interpreted in accordance with Colorado law. <br /> D. This Lease may be amended only in writing signed by both parties. <br /> E. Paragraph headings are for convenience only and shall not be considered in <br /> any controversy involving the meaning and intent of this Lease. <br /> F. This Lease may be executed in counterparts. <br /> G. If any term or provision of this Lease shall be found to be invalid or <br /> unenforceable,the remaining terms and provisions of this Lease shall be valid <br /> and enforceable to the fullest extent permitted by law. <br /> H.
