The Tenant shall be responsible for applying for all permits necessary to <br /> obtain legal permission to conduct its mining operations including the Reclamation <br /> Plan. The Landlord, for herself, her successors and assigns, agrees to cooperate in <br /> all reasonable ways in Tenant's efforts to obtain such permits and agrees to furnish, <br /> without cost, all information regarding the Property which she has insofar as such <br /> information relates to sand, gravel, aggregate and other minerals. Tenant shall be <br /> solely responsible for all costs and fees of obtaining the necessary permits for its <br /> proposed mining operations and reclamation, which shall be the sole and separate <br /> property of Tenant. <br /> 15. Agreement Concerning Water Augmentation. Tenant shall be responsible and pay <br /> for water augmentation required due to Tenant's mining of the Property. Landlord <br /> shall be responsible and pay all assessments on the Whitney Ditch. Tenant may use <br /> all necessary Whitney Ditch water11 � <br /> be,h,� u--col ca, A-�, t�e Fk.,J'1J <br /> 16, Additional Tenant Covenants. <br /> A. Tenant will cause all operations under this Lease to be carried on in <br /> accordance with all applicable federal,state and local regulations,permits,and <br /> the terms and conditions of any bond issued relative to such operations. <br /> B. Tenant shall keep the Property free and clear of liens for labor done or work <br /> performed under this Lease, and shall keep the Property free from all other <br /> forms of encumbrance, and will hold Landlord harmless from all claims, <br /> demand, suits, liabilities, damages, losses, costs, and expenses (including <br /> reasonable attorney fees) which may arise by reason of injury to any person <br /> employed by Tenant on the Property, or which may arise by any reason of <br /> injury to any person or damage to any property as a result of any operations <br /> of Tenant. Tenant shall name Landlord as an additional insured under <br /> Tenant's applicable insurance policy. <br /> C. Any use,storage,treatment, disposal or release of hazardous materials on the <br /> Property by Tenant shall be in compliance with all applicable federal and state <br /> laws and regulations. Upon termination of this Lease,Tenant shall remove all <br /> hazardous materials used, stored,treated,disposed of or released by it on the <br /> Property during the Lease Term.
