Section 2.9"Binding Effect" The Property and all lots within said Property as herein described shall be bound by these Declarations. Article III Use Restrictions The property shall be held, used and enjoyed subject to the following limitations and restrictions: Section 3.1 "Lot Size"All lots as described in the survey which shall be recorded in the County of Huerfano, State of Colorado, cannot be divided into smaller parcels. These lots are at least 35 acres and must remain so. The only exception to this is if the County of Huerfano gives permission to reduce the size of the lots. Section 3.2 and Agricultural Use" Each Lot shall be used as a residence for a single family. The primary use of the lot shall be for agriculture. Section 3.3 No improvements of these lots can be made without receiving a building permit from the Health Department of the State of Colorado. Each individual lot owner must make application on his own behalf and each lot must obtain a permit from the Department of Health,particularly,regarding sewage disposal. Section 3.4 "Nuisances"No noxious or offensive activity shall be carried on, in or upon any lot, nor shall anything be done thereon which may be or become an unreasonable annoyance or nuisance to any other owner or which may interfere with his quiet enjoyment of his lot. Section 3.5"Drilling and Mining"No oil drilling, mining, quarrying or related operations of any kind shall be permitted on the Property. Section 3.6 "Rubbish"No rubbish or junked vehicles shall be stored or allowed to accumulate anywhere on the Property. All trash and rubbish shall be taken to the durnpster which shall be provided by the Association for pielcup by the County at an area designated by the County for such pickup.
