PERMIT#: M-2016-041 <br /> INSPECTOR'S INITIALS:ECS <br /> INSPECTION DATE:April 17,2017 <br /> INSPECTION TOPIC: Signs & Markers <br /> PROBLEM/POSSIBLE VIOLATION: Problem:The affected area boundary markers are missing or incorrectly <br /> placed. This is a problem for failure to maintain boundary markers around the affected area as required by <br /> Section 3.1.12(2) of the rule. Only the SE corner permit boundary marker was able to be located in the field. <br /> CORRECTIVE ACTIONS:The operator shall conduct a survey and replace the boundary markers in the correct <br /> location(s). The operator shall provide proof to the Division that this has been done by the corrective action <br /> date.The Operator shall also accurately delineate all other activities taking place within and adjacent to the <br /> approved permit area (asphalt recycling, water truck fill, etc) as well as the existing excavated area. <br /> CORRECTIVE ACTION DUE DATE: 5/31/17 <br /> OBSERVATIONS <br /> The Front Range Feed Lot Borrow permit is an 8 acre 111 permit that was issued in August of 2016 for a <br /> roadway improvement project on Weld County Road 49. This permit was inspected by Eric Scott with the <br /> Division of Reclamation, Mining and Safety (Division) as part of the Division's monitoring inspection program. <br /> Mr. Kyle Reinholt of Ames construction was the permittee representative present for the inspection. <br /> The configuration of the approved permit area consists of a rectangular area with two extensions to the north for <br /> access to and from the existing dirt road (see attached map). The Division holds a financial warranty in the <br /> amount of$20,000.00, which may not be adequate to reclaim the site based on this inspection. Permit boundary <br /> markers as required by Rule 3.1.12 were not able to be located during this inspection. <br /> Mr. Reinholt informed DRMS that most of the existing disturbance was due to the fact that Ames construction <br /> had been utilizing this property for the main highway project staging and work yard, in addition to a borrow <br /> area. Ames construction has utilized the portions of the permitted area and the surrounding area for a variety of <br /> activities associated with the overall construction project including asphalt recycling, concrete washout, water <br /> truck filling, equipment parking, material storage, etc (see attached photos). Because of the lack of permit <br /> boundary markers, it was impossible to accurately assess during this inspection which of these additional <br /> activities (none of which are currently part of the approved mine plan) are taking place in the approved DRMS <br /> permit area. <br /> It was also noted that activity was occurring well within 200' of the existing gas well and property fence <br /> without an executed damage waiver agreement, and at least a portion of the affected topsoil within the DRMS <br /> permit area has not been properly salvaged and segregated for use in reclamation. <br /> DRMS will review the information provided by the permittee as required by the corrective actions listed in this <br /> report to determine what permitting or enforcement actions will be required to bring this permit back into <br /> compliance. <br /> Photographs taken during the inspection, and the approved Mining Plan map as submitted by the permittee are <br /> attached. <br /> Page 2 of 4 <br />
