State of Colorado <br /> Division of Reclamation, Mining and Safety <br /> Department of Natural Resources <br /> April 18, 2017 <br /> Page 3. <br /> (ii) The Borsis: <br /> The Borsis are the owners of a lot within Sun River directly south of the Perrino <br /> Property. (Exhibit A). Their property rights in the common elements of Sun River, <br /> including the Access Road, would be directly and adversely affected or aggrieved by the <br /> use of the Access Road by a third-party, including the Applicant. <br /> (iii) The Mitchells: <br /> The Mitchells are the owners of a lot within Sun River south west of the Perrino <br /> Property. In addition, the northern one half of the Access Road is within the Mitchell <br /> property. (See Exhibit B, as attached). The Mitchells' fee interest in their lot, and their <br /> property rights in the common elements of Sun River including the northern half of the <br /> Access Road, would be directly and adversely affected or aggrieved by the use of the <br /> Access Road by a third-party, including the Applicant. <br /> Accordingly and pursuant to the Rules and Regulations, Rule 1, 1.1, (34.1) the <br /> Interested Parties', (SRRRA, the Borsis and the Mitchells), are proper parties to submit <br /> their herein objection, and their interests are entitled to legal protection under the <br /> Colorado Land Reclamation Act for the Extraction of Construction Materials, §34-32.5- <br /> 101, et seq., C.R.S. 1984, as amended. <br /> TIMELINESS <br /> The Rules and Regulations, Rule 1, 1.7.1(2)(a) require that the objection to the <br /> Application and petition to a hearing shall be submitted and received by the Mine Land <br /> Reclamation Division not more than twenty (20) calendar days after the date of last <br /> publication of the notice of the Application. <br /> According to Colorado Crushing, Inc.'s Public Notice any written comment to the <br /> Application must be received by the Mine Land Reclamation Division no later than 4:00 <br /> p.m., April 26, 2017, which date has not passed yet at the time of the submission of this <br /> letter of objection. <br /> ARGUMENT <br /> (i) The Perrinos Did Not State in the Application That They Have Any Rim <br />
